SYNOPSIS AS INTRODUCED:
 
720 ILCS 5/21-3.5 new

    Amends the Criminal Code of 1961. Creates the offense of criminal trespass to an agricultural facility. Defines the offense as entering upon lands or buildings owned by any other person without the license of the owner or legal occupant, where signs forbidding trespass are displayed, and where cattle, goats, pigs, sheep, fowl, or any other animal is being raised, bred, fed, or held for the purpose of food for human consumption; or injuring, gathering, or carrying away any animal being housed on any of those lands, without the license of the owner or legal occupant; or damaging, destroying, or removing, or causing to be removed, damaged, or destroyed, any stakes, marks, fences, or signs intended to designate the boundaries and limits of any of those lands. Provides that criminal trespass to an agricultural facility is a Class B misdemeanor.

1     AN ACT concerning criminal law.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Criminal Code of 1961 is amended by adding
5 Section 21-3.5 as follows:
 
6     (720 ILCS 5/21-3.5 new)
7     Sec. 21-3.5. Criminal trespass to an agricultural
8 facility.
9     (a) A person commits the offense of criminal trespass to an
10 agricultural facility when he or she enters upon lands or
11 buildings owned by any other person without the license of the
12 owner or legal occupant, where signs forbidding trespass are
13 displayed, and where cattle, goats, pigs, sheep, fowl, or any
14 other animal is being raised, bred, fed, or held for the
15 purpose of food for human consumption; or injures, gathers, or
16 carries away any animal being housed on any of those lands,
17 without the license of the owner or legal occupant; or damages,
18 destroys, or removes, or causes to be removed, damaged, or
19 destroyed, any stakes, marks, fences, or signs intended to
20 designate the boundaries and limits of any of those lands.
21     (b) This Section may not be construed to preclude
22 prosecution or punishment under any other provision of law,
23 including, but not limited to, theft or any provision that
24 provides for a greater penalty or longer term of imprisonment.
25     (c) Criminal trespass to an agricultural facility is a
26 Class B misdemeanor.
