SYNOPSIS AS INTRODUCED:
 
20 ILCS 2310/2310-353

    Amends the Department of Public Health Powers and Duties Law of the Civil Administrative Code of Illinois. Creates the Cervical, Breast, and Ovarian Cancer Elimination Task Force (rather than the Cervical Cancer Elimination Task Force). Makes other changes accordingly.

1     AN ACT concerning State government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Department of Public Health Powers and
5 Duties Law of the Civil Administrative Code of Illinois is
6 amended by changing Section 2310-353 as follows:
 
7     (20 ILCS 2310/2310-353)
8     Sec. 2310-353. Cervical, Breast, and Ovarian Cancer
9 Elimination Task Force.
10     (a) A standing Task Force on Cervical, Breast, and Ovarian
11 Cancer Elimination ("Task Force") is established within the
12 Illinois Department of Public Health.
13     (b) The Task Force shall have 12 members appointed by the
14 Director of Public Health as follows:
15         (1) A representative of an organization relating to
16     women and cancer.
17         (2) A representative of an organization providing
18     health care to women.
19         (3) A health educator.
20         (4) A representative of a national organization
21     relating to cancer treatment who is an oncologist.
22         (5) A representative of the health insurance industry.
23         (6) A representative of a national organization of
24     obstetricians and gynecologists.
25         (7) A representative of a national organization of
26     family physicians.
27         (8) The State Epidemiologist.
28         (9) A member at-large with an interest in women's
29     health.
30         (10) A social marketing expert on health issues.
31         (11) A licensed registered nurse.
32         (12) A member of the Illinois Breast and Cervical

1     Cancer Medical Advisory Committee.
2     The directors of Public Health and Public Aid, and the
3 Secretary of Human Services, or their designees, and the Chair
4 and Vice-Chair of the Conference of Women Legislators in
5 Illinois, or their designees, shall be ex officio members of
6 the Task Force. The Director of Public Health shall also
7 consult with the Speaker of the House of Representatives, the
8 Minority Leader of the House of Representatives, the President
9 of the Senate, and the Minority Leader of the Senate in the
10 designation of members of the Illinois General Assembly as
11 ex-officio members.
12     Appointments to the Task Force should reflect the
13 composition of the Illinois population with regard to ethnic,
14 racial, age, and religious composition.
15     (c) The Director of Public Health shall appoint a Chair
16 from among the members of the Task Force. The Task Force shall
17 elect a Vice-Chair from its members. Initial appointments to
18 the Task Force shall be made not later than 30 days after the
19 effective date of this amendatory Act of the 93rd General
20 Assembly. A majority of the Task Force shall constitute a
21 quorum for the transaction of its business. The Task Force
22 shall meet at least quarterly. The Task Force Chair may
23 establish sub-committees for the purpose of making special
24 studies; such sub-committees may include non-Task-Force
25 members as resource persons.
26     (d) Members of the Task Force shall be reimbursed for their
27 necessary expenses incurred in performing their duties. The
28 Department of Public Health shall provide staff and technical
29 assistance to the Task Force to the extent possible within
30 annual appropriations for its ordinary and contingent
31 expenses.
32     (e) The Task Force shall have the following duties:
33         (1) To obtain from the Department of Public Health, if
34     available, data and analyses regarding the prevalence and
35     burden of cervical, breast, and ovarian cancer. The Task
36     Force may conduct or arrange for independent studies and

1     analyses.
2         (2) To coordinate the efforts of the Task Force with
3     existing State committees and programs providing cervical,
4     breast, and ovarian cancer screening, education, and case
5     management.
6         (3) To raise public awareness on the causes and nature
7     of cervical, breast, and ovarian cancer, personal risk
8     factors, the value of prevention, early detection, options
9     for testing, treatment costs, new technology, medical care
10     reimbursement, and physician education.
11         (4) To identify priority strategies, new technologies,
12     and newly introduced vaccines that are effective in
13     preventing and controlling the risk of cervical, breast,
14     and ovarian cancer.
15         (5) To identify and examine the limitations of existing
16     laws, regulations, programs, and services with regard to
17     coverage and awareness issues for cervical, breast, and
18     ovarian cancer, including requiring insurance or other
19     coverage for PAP smears and mammograms in accordance with
20     the most recently published American Cancer Society
21     guidelines.
22         (6) To develop a statewide comprehensive Cervical,
23     Breast, and Ovarian Cancer Prevention Plan and strategies
24     for implementing the Plan and for promoting the Plan to the
25     general public, State and local elected officials, and
26     various public and private organizations, associations,
27     businesses, industries, and agencies.
28         (7) To receive and to consider reports and testimony
29     from individuals, local health departments,
30     community-based organizations, voluntary health
31     organizations, and other public and private organizations
32     statewide to learn more about their contributions to
33     cervical, breast, and ovarian cancer diagnosis,
34     prevention, and treatment and more about their ideas for
35     improving cervical, breast, and ovarian cancer prevention,
36     diagnosis, and treatment in Illinois.

1     (f) The Task Force shall submit a report to the Governor
2 and the General Assembly by April 1, 2006 2005 and by April 1
3 of each year thereafter. The report shall include (i)
4 information regarding the progress being made in fulfilling the
5 duties of the Task Force and in developing the Cervical,
6 Breast, and Ovarian Cancer Prevention Plan and (ii) recommended
7 strategies or actions to reduce the occurrence of cervical,
8 breast, and ovarian cancer and the burdens from cervical,
9 breast, and ovarian cancer suffered by citizens of this State.
10     (g) The Task Force shall expire on April 1, 2009, or upon
11 submission of the Task Force's final report to the Governor and
12 the General Assembly, whichever occurs earlier.
