1     AN ACT concerning criminal law.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Partial-birth Abortion Ban Act is amended by
5 changing Section 10 as follows:
 
6     (720 ILCS 513/10)
7     Sec. 10. Partial-birth abortions prohibited. Any person
8 who knowingly performs a partial-birth abortion and and thereby
9 kills a human fetus or infant is guilty of a Class 4 felony.
10 This Section does not apply to a partial-birth abortion that is
11 necessary to save the life of a mother because her life is
12 endangered by a physical disorder, physical illness, or
13 physical injury, including a life-endangering condition caused
14 by or arising from the pregnancy itself, provided that no other
15 medical procedure would suffice for that purpose.
