    Amends the Nursing and Advanced Practice Nursing Act. Makes a technical change in a Section concerning powers and duties of the Department.

1     AN ACT concerning regulation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Nursing and Advanced Practice Nursing Act is
5 amended by changing Section 10-10 as follows:
 
6     (225 ILCS 65/10-10)
7     (Section scheduled to be repealed on January 1, 2008)
8     Sec. 10-10. Department powers and duties.
9     (a) The The Department shall exercise the powers and duties
10 prescribed by the Civil Administrative Code of Illinois for
11 administration of licensing acts and shall exercise other
12 powers and duties necessary for effectuating the purpose of
13 this Act. None of the functions, powers, or duties of the
14 Department with respect to licensure and examination shall be
15 exercised by the Department except upon review by the Board.
16 The Department shall adopt rules to implement, interpret, or
17 make specific the provisions and purposes of this Act; however
18 no such rules shall be adopted by the Department except upon
19 review by the Board.
20     (b) The Department shall:
21         (1) prepare and maintain a list of approved programs of
22     professional nursing education and programs of practical
23     nursing education in this State, whose graduates, if they
24     have the other necessary qualifications provided in this
25     Act, shall be eligible to apply for a license to practice
26     nursing in this State;
27         (2) promulgate rules defining what constitutes an
28     approved program of professional nursing education and
29     what constitutes an approved program of practical nursing
30     education; and
31         (3) adopt rules for examination of candidates for
32     licenses and for issuance of licenses authorizing

1     candidates upon passing an examination to practice under
2     this Act.
