SYNOPSIS AS INTRODUCED:
 
New Act

    Creates the Electronic Medical Records Taskforce Act. Establishes the Electronic Medical Records Taskforce to create a plan for the development and utilization of electronic medical records (EMR) in the State in order to improve the quality of patient care, increase the efficiency of medical practice, improve safety, and reduce medical errors. Sets forth certain elements that the plan shall include. Effective immediately.

1     AN ACT concerning regulation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 1. Short title. This Act may be cited as the
5 Electronic Medical Records Taskforce Act.
 
6     Section 5. Electronic Medical Records Taskforce
7 established. There is hereby created the Electronic Medical
8 Records Taskforce, hereinafter referred to as the EMR
9 Taskforce. The EMR Taskforce shall be convened by the
10 Department of Public Health, in coordination with the
11 Department of Public Aid.
 
12     Section 10. Taskforce duties; membership.
13     (a) The EMR Taskforce shall create a plan for the
14 development and utilization of electronic medical records
15 (EMR) in the State in order to improve the quality of patient
16 care, increase the efficiency of medical practice, improve
17 safety, and reduce medical errors. The EMR plan shall provide
18 policy guidance for application for federal, State, or private
19 grants to phase in utilization of EMR by health care providers.
20     (b) The Taskforce shall include representatives of
21 physicians, hospitals, pharmacies and long-term care
22 facilities, academic medical centers, payors, patients and
23 consumers, and information technology providers.
 
24     Section 15. EMR plan. The EMR plan shall include, but not
25 be limited to, a consideration of all of the following:
26         (1) key components of and standards for comprehensive
27     EMR systems for recording, storing, analyzing and
28     accessing patient medical information, assisting with
29     medical decision-making and quality assurance, and
30     providing for online health care;

1         (2) consistent data elements, definitions, and formats
2     that should be incorporated in EMR systems;
3         (3) analysis of costs and benefits in implementing EMR
4     by various types and sizes of health care providers;
5         (4) survey of equipment, technical assistance, and
6     resources that would be necessary to assist smaller health
7     care providers with EMR implementation and utilization;
8         (5) standards, technology platforms, and issues
9     related to patient access to their individual medical and
10     health data;
11         (6) a potential phase-in plan for implementing EMR by
12     health care providers throughout Illinois; and
13         (7) patient privacy, security, and compliance with
14     applicable rules set forth in the federal Health Insurance
15     Portability and Accountability Act of 1996 (HIPAA).
 
16     Section 99. Effective date. This Act takes effect upon
17 becoming law.
