    Amends the School Code. Requires school districts to restrict access to vending machine products during times when school breakfasts and lunches are being served. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.

1     AN ACT concerning schools.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The School Code is amended by adding Sections
5 10-20.40 and 34-18.32 as follows:
 
6     (105 ILCS 5/10-20.40 new)
7     Sec. 10-20.40. Vending machine access. Each school board
8 shall restrict access to vending machine products during times
9 when school breakfasts, if a school offers breakfast, and
10 school lunches are being served.
 
11     (105 ILCS 5/34-18.32 new)
12     Sec. 34-18.32. Vending machine access. The board shall
13 restrict access to vending machine products during times when
14 school breakfasts, if a school offers breakfast, and school
15 lunches are being served.
 
16     Section 90. The State Mandates Act is amended by adding
17 Section 8.29 as follows:
 
18     (30 ILCS 805/8.29 new)
19     Sec. 8.29. Exempt mandate. Notwithstanding Sections 6 and 8
20 of this Act, no reimbursement by the State is required for the
21 implementation of any mandate created by this amendatory Act of
22 the 94th General Assembly.
 
23     Section 99. Effective date. This Act takes effect upon
24 becoming law.
