1     AN ACT concerning animals.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Wildlife Code is amended by changing
5 Sections 3.19 and 3.20 and adding Section 3.16a as follows:
 
6     (520 ILCS 5/3.16a new)
7     Sec. 3.16a. Non-resident auction participation permit;
8 fee. Any individual who is not a resident of the State of
9 Illinois and does not possess a non-resident fur buyer permit
10 must obtain a non-resident auction participation permit to
11 receive, collect, buy, or act as an agent or broker in the
12 receipt, collection, or purchase of the green hides of
13 fur-bearing mammals at auctions organized for these purposes
14 within the State of Illinois. Non-resident auction
15 participation permits shall be issued by the Department. The
16 annual fee for each non-resident auction participation permit
17 is $50. Non-resident auction participation permits expire on
18 April 30. A holder of a non-resident auction participation
19 permit may receive, collect, buy, possess, transport, or act as
20 an agent or broker in the receipt, collection, or purchase of
21 legally taken fur-bearing mammals from May 1 through the next
22 April 30. Failure to establish proof of legality or origin of
23 the green hides of fur-bearing mammals, however, is prima facie
24 evidence that the green hides are contraband within the State
25 of Illinois. Nothing in this Section exempts any permittee from
26 complying with any federal laws, rules, or regulations that may
27 apply to the green hides of fur-bearing mammals.

29     Sec. 3.19. Each resident retail fur buyer, resident
30 wholesale fur buyer, nonresident fur buyer, non-resident
31 auction participant, fur bearing mammal breeder or fur tanner

1 shall have his permit in his possession when receiving,
2 collecting, buying, selling, or offering for sale, the green
3 hides of fur-bearing or game mammals or accepting the same for
4 dressing, dyeing, or tanning, and shall immediately produce the
5 same when requested to do so by an officer or authorized
6 employees of the Department, any sheriff, deputy sheriff or any
7 other peace officer. Persons conducting organized and
8 established auction sales or the green hides of fur-bearing or
9 game mammals, protected by this Act, shall be exempt from the
10 provisions of this Section.

13     Sec. 3.20. All fur buyers and non-resident auction
14 participants, shall, upon purchasing any green hide of any
15 fur-bearing mammal, protected by this Act, issue a numbered
16 receipt to the hunter, trapper, fur buyer, fur-bearing mammal
17 breeder or other person from whom he purchased such hides,
18 setting forth the number and kinds of green hides, the date of
19 purchase, the price paid for each hide, the name and address of
20 the hunter, trapper, fur buyer, fur-bearing mammal breeder or
21 other person from whom he purchased such hides, and the
22 appropriate license number or stamp number of the hunter,
23 trapper, fur buyer, fur-bearing mammal breeder or other person
24 from whom the hides were purchased, if applicable. The original
25 receipt shall be retained by the fur buyer for a minimum of 2
26 years from the date of purchase listed on the receipt. A
27 duplicate receipt shall be given to the hunter, trapper, fur
28 buyer, fur-bearing mammal breeder or other person from whom the
29 green hides were purchased at the time of purchase.
30     All fur buyers shall submit a report to the Department on
31 forms provided by the Department showing the number and kinds
32 of all green hides of fur-bearing mammals received, collected
33 or purchased, and the average price, if any, paid therefore and
34 such other information as required by the Department. This
35 report shall be made on or before May 10 of each year and shall

1 include all operations for the 12 months preceding May 1 of the
2 current year. All such receipts, reports, and records required
3 by this Section shall be available for inspection by any
4 officer or authorized employee of the Department, any sheriff,
5 deputy sheriff, or any other peace officer at any reasonable
6 time when request is made for same. Failure to comply with the
7 provisions of this Section shall bar the permittee from
8 obtaining a fur buyer permit for the following year.
