1     AN ACT concerning business.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Copper Purchase Registration Law is amended
5 by changing Sections 3, 5, and 6 as follows:
 
6     (815 ILCS 325/3)  (from Ch. 121 1/2, par. 323)
7     Sec. 3. Except as provided in Section 5 of this Act every
8 copper dealer in this State shall enter in triplicate on forms
9 provided by the Department of State Police or such department
10 as may succeed to its functions, for each purchase of copper
11 consisting of 50 pounds or more the following information:
12     1. The name and address of the copper dealer;
13     2. The date and place of each purchase;
14     3. The name and address of the person or persons from whom
15 the copper was purchased;
16     4. The motor vehicle license number of the vehicle or
17 conveyance on which the copper was delivered to the copper
18 dealer;
19     5. A description of the copper purchased, including the
20 weight and whether it consists of bars, cable, ingots, rods,
21 tubing, wire, wire scraps, clamps, connectors or other
22 appurtenances or some combination thereof.
23     A One copy of the completed form shall be kept in a
24 separate book or register by the copper dealer and shall be
25 retained for a period of 2 years one year. Such book or
26 register shall be made available for inspection by any law
27 enforcement official or the representatives of common carriers
28 and persons, firms, corporations or municipal corporations
29 engaged in either the generation, transmission or distribution
30 of electric energy or engaged in telephone, telegraph or other
31 communications, at any time. Within 3 days from the day of
32 purchase one copy of the completed form shall be filed in the

1 office of the county clerk of the county in which the copper
2 was purchased and one copy shall be filed with, or mailed to,
3 the Department of State Police, or such department as may
4 succeed to its functions.

7     Sec. 5. The provisions of Section Sections 3 and 4 of this
8 Act do not apply to electrical contractors, to agencies or
9 instrumentalities of the State of Illinois or of the United
10 States, to common carriers or to purchases from persons, firms
11 or corporations regularly engaged in the business of
12 manufacturing copper, the business of selling copper at retail
13 or wholesale, in the business of razing, demolishing,
14 destroying or removing buildings, to the purchase of one copper
15 dealer from another or the purchase from persons, firms or
16 corporations engaged in either the generation, transmission or
17 distribution of electric energy or in telephone, telegraph and
18 other communications if such common carriers, persons, firms or
19 corporations at the time of the purchase provide the copper
20 dealer with a bill of sale or other written evidence of title
21 to the copper.

24     Sec. 6. The Department of State Police, or such department
25 as may succeed to its functions, shall prepare the forms
26 provided for in Section 3 of this Act and , shall make an
27 electronic copy a reasonable supply of the form forms available
28 to the public on its website at the office of the county clerk
29 of each county and shall provide the forms to any individual
30 upon request.
