    Amends the Organ Donor Leave Act. Provides that the Act applies to all public employers in the State and to all private employers in the State who have 15 or more employees (now, the Act applies only to any branch, department, board, committee, or commission of State government).

1     AN ACT concerning employment.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Organ Donor Leave Act is amended by changing
5 Sections 5, 10, and 20 as follows:

7     Sec. 5. Purpose. This Act is intended to provide time off
8 with pay for State employees who donate an organ, bone marrow,
9 blood, or blood platelets.

12     Sec. 10. Definitions. As used in this Act:
13     "Employer" "Agency" means any branch, department, board,
14 committee, or commission of State government, but does not
15 include units of local government, school districts, and or
16 boards of election commissioners. The term "employer" also
17 includes any private employer in the State who has 15 or more
18 employees.
19     "Department" means the Department of Central Management
20 Services.
21     "Participating employee" means a permanent full-time or
22 part-time employee who has been employed by an employer agency
23 for a period of 6 months or more and who donates an organ, bone
24 marrow, blood, or blood platelets.

27     Sec. 20. Administration of Act.
28     (a) On request, a participating employee subject to this
29 Act may be entitled to organ donation leave with pay.
30     (b) An employee may use (i) up to 30 days of organ donation

1 leave in any 12-month period to serve as a bone marrow donor,
2 (ii) up to 30 days of organ donation leave in any 12-month
3 period to serve as an organ donor, (iii) up to one hour to
4 donate blood every 56 days, and (iv) up to 2 hours to donate
5 blood platelets in accordance with appropriate medical
6 standards established by the American Red Cross or other
7 nationally-recognized standards. Leave under item (iv) need
8 may not be granted more than 24 times in a 12-month period.
9     (c) An employee may use organ donation leave or other leave
10 authorized in subsection (b) of this Section only after
11 obtaining approval from his or her employer the employee's
12 agency.
13     (d) An employee may not be required to use accumulated sick
14 or vacation leave time before being eligible for organ donor
15 leave.
16     (e) The Department must adopt rules governing organ
17 donation leave for State employees, including rules that (i)
18 establish conditions and procedures for requesting and
19 approving leave and (ii) require medical documentation of the
20 proposed organ or bone marrow donation before leave is approved
21 by the employing agency.
