SYNOPSIS AS INTRODUCED:
 
50 ILCS 705/10.7 new
30 ILCS 805/8.29 new

    Amends the Illinois Police Training Act. Requires each police chief and deputy police chief to obtain at least 20 hours of training each year. Requires the training to be approved by the Law Enforcement Training and Standards Board and to concern certain topics. Provides that attending a conference held by an association that represents chiefs of police satisfies the training requirement. Requires the municipality to reimburse the police chief and deputy police chief for reasonable expenses incurred in obtaining the required training. Preempts home rule. Amends the State Mandates Act to require implementation without reimbursement by the State.

1     AN ACT concerning law enforcement.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Police Training Act is amended by
5 adding Section 10.7 as follows:
 
6     (50 ILCS 705/10.7 new)
7     Sec. 10.7. Mandatory training; police chief and deputy
8 police chief.
9     (a) Each police chief and deputy police chief shall obtain
10 at least 20 hours of training each year. The training must be
11 approved by the Illinois Law Enforcement Training and Standards
12 Board and must be related to law enforcement, management or
13 executive development, or ethics. This requirement may be
14 satisfied by attending a conference held by an association that
15 represents chiefs of police. Any police chief and any deputy
16 police chief, upon presentation of a certificate of completion
17 from the person or entity conducting the training, shall be
18 reimbursed by the municipality for his or her reasonable
19 expenses in obtaining the training required under this Section.
20     (b) Units of local government, including home rule units,
21 may not regulate the training of police chiefs and deputy
22 police chiefs in a manner less restrictive than the regulation
23 by the State of the training of police chiefs and deputy police
24 chiefs under this Section. This Section is a limitation under
25 subsection (i) of Section 6 of Article VII of the Illinois
26 Constitution on the concurrent exercise by home rule units of
27 powers and functions exercised by the State.
 
28     Section 90. The State Mandates Act is amended by adding
29 Section 8.29 as follows:

1     Sec. 8.29. Exempt mandate. Notwithstanding Sections 6 and 8
2 of this Act, no reimbursement by the State is required for the
3 implementation of any mandate created by this amendatory Act of
4 the 94th General Assembly.
