SYNOPSIS AS INTRODUCED:

20 ILCS 862/55 new

    Amends the Recreational Trails of Illinois Act. Provides that no person may operate an off-highway vehicle in any public off-highway vehicle park paid for, operated, or supported by the grant program administered under the Act unless an identification tag is clearly displayed on the vehicle. Provides that any person driving or operating an off-highway vehicle in a public off-highway vehicle park paid for, operated, or supported by the grant program who is found to have fled or attempted to elude a peace officer shall be assessed an administrative fine of $500, in addition to the criminal penalties imposed under the Illinois Vehicle Code.

1     AN ACT concerning recreation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Recreational Trails of Illinois Act is
5 amended by adding Sections 50 and 55 as follows:
 
6     (20 ILCS 862/50 new)
7     Sec. 50. Identification tag.
8     (a) Except as provided in subsection (b) of this Section, a
9 person may not operate an off-highway vehicle in any public
10 off-highway vehicle park paid for, operated, or supported by
11 the grant program established under subsection (d) of Section
12 15 unless the off-highway vehicle clearly displays an
13 off-highway vehicle identification tag.
14     (b) An off-highway vehicle identification tag is not needed
15 to operate an off-highway vehicle on private land.
16     (c) The Department shall issue the identification tags and
17 shall charge only that amount necessary to cover the cost of
18 issuing the tags. Fees collected under this subsection (c)
19 shall be deposited into the Off-Highway Vehicle Trails Fund.
20     (d) The Department may, by administrative rule, establish
21 rules and regulations for carrying out, administering, and
22 enforcing the provisions of this Section.

24     Sec. 55. Penalties for fleeing or attempting to elude a
25 peace officer.
26     (a) Any driver or operator of an off-highway vehicle who,
27 having been given a visual or audible signal by a peace officer
28 directing that driver or operator to bring his or her
29 off-highway vehicle to a stop, is found to have willfully
30 failed or refused to obey the direction, increased his or her
31 speed, or otherwise fled or attempted to elude the officer

1 while driving or operating an off-highway vehicle in a public
2 off-highway vehicle park paid for, operated, or supported by
3 the grant program established under subsection (d) of Section
4 15 shall be assessed a $500 administrative fine in addition to
5 the criminal penalties imposed under the Illinois Vehicle Code.
6 Moneys collected as a result of this administrative fine shall
7 be deposited into the Off-Highway Vehicle Trails Fund.
8     (b) The Department may, by administrative rule, establish
9 rules and regulations for enforcing and collecting the fine
10 established under this Section.
