SYNOPSIS AS INTRODUCED:

    Amends the Illinois Lottery Law. Creates a special instant scratch-off game for the benefit of the Lyme Disease Innovation Program, which helps to further education and awareness of Lyme disease in Illinois. Provides that the game shall commence on January 1, 2025 or as soon thereafter as is reasonably practical. Provides that funds raised from the purchase of the instant scratch-off game shall be deposited into the Lyme Disease Awareness Fund. Provides that the marketing of any other instant scratch-off game shall not be unreasonably diminished during the promotion and sale of the Lyme disease instant scratch-off. Makes conforming changes. Effective immediately.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Lottery Law is amended by changing
5Sections 9.3 and 20 and by adding Section 21.18 as follows:
 
6    (20 ILCS 1605/9.3)
7    Sec. 9.3. Expenditure and distribution of lottery
8proceeds.
9    (a) Beginning July 1, 2022, except as provided in Sections
1021.4, 21.5, 21.6, 21.7, 21.8, 21.9, 21.10, 21.11, 21.13,
1121.15, and 21.16, and 21.18 of this Law and Section 25-70 of
12the Sports Wagering Act, the Department shall distribute all
13proceeds of lottery tickets and shares sold in the following
14priority and manner:
15        (1) The payment of prizes and retailer bonuses.
16        (2) The payment of costs incurred in the operation and
17    administration of the Lottery, including the payment of
18    sums due to the private manager under the management
19    agreement with the Department and including costs of
20    administering the Lottery sports wagering program pursuant
21    to Section 25-70 of the Sports Wagering Act.
22        (3) On the last day of each month or as soon thereafter
23    as possible, the State Comptroller shall direct and the

1    State Treasurer shall transfer from the State Lottery Fund
2    to the Common School Fund the Department's estimate of net
3    lottery proceeds.
4        (4) If an amount in excess of the annual net lottery
5    proceeds is transferred for a fiscal year, then the
6    Department shall offset the monthly transfers of estimated
7    net lottery proceeds during the following fiscal year by
8    that excess amount. If an amount less than the annual net
9    lottery proceeds is transferred for a fiscal year, then
10    after the related annual fiscal year audit is completed
11    following such fiscal year, the Department shall direct
12    the deposit of any remaining annual net lottery proceeds
13    from such fiscal year, subject to payments under
14    paragraphs (1) and (2), into the Common School Fund as
15    soon thereafter as possible.
16    (b) The net lottery proceeds shall be determined by
17deducting from total annual lottery proceeds the expenditures
18required by paragraphs (1) and (2) of subsection (a). The
19total annual lottery proceeds and annual net lottery proceeds
20shall be determined according to generally accepted accounting
21principles for governmental entities and verified by an annual
22fiscal year audit.

25    Sec. 20. State Lottery Fund.

1    (a) There is created in the State Treasury a special fund
2to be known as the State Lottery Fund. Such fund shall consist
3of all revenues received from (1) the sale of lottery tickets
4or shares, (net of commissions, fees representing those
5expenses that are directly proportionate to the sale of
6tickets or shares at the agent location, and prizes of less
7than $600 which have been validly paid at the agent level), (2)
8application fees, and (3) all other sources including moneys
9credited or transferred thereto from any other fund or source
10pursuant to law. Interest earnings of the State Lottery Fund
11shall be credited to the Common School Fund.
12    (a-5) The receipt and distribution of moneys under Section
1321.4 of this Act shall be in accordance with Section 21.4.
14    (b) The receipt and distribution of moneys under Section
1521.5 of this Law shall be in accordance with Section 21.5.
16    (c) The receipt and distribution of moneys under Section
1721.6 of this Law shall be in accordance with Section 21.6.
18    (d) The receipt and distribution of moneys under Section
1921.7 of this Law shall be in accordance with Section 21.7.
20    (e) The receipt and distribution of moneys under Section
2121.8 of this Law shall be in accordance with Section 21.8.
22    (f) The receipt and distribution of moneys under Section
2321.9 of this Law shall be in accordance with Section 21.9.
24    (g) The receipt and distribution of moneys under Section
2521.10 of this Law shall be in accordance with Section 21.10.
26    (h) The receipt and distribution of moneys under Section

121.11 of this Law shall be in accordance with Section 21.11.
2    (i) (Blank).
3    (j) The receipt and distribution of moneys under Section
421.13 of this Law shall be in accordance with Section 21.13.
5    (k) The receipt and distribution of moneys under Section
625-70 of the Sports Wagering Act shall be in accordance with
7Section 25-70 of the Sports Wagering Act.
8    (l) The receipt and distribution of moneys under Section
921.15 of this Law shall be in accordance with Section 21.15.
10    (m) The receipt and distribution of moneys under Section
1121.16 of this Law shall be in accordance with Section 21.16.
12    (n) The receipt and distribution of moneys under Section
1321.18 of this Law shall be in accordance with Section 21.18.

16    Sec. 21.18. Scratch-off for the Lyme Disease Innovation
17Program.
18    (a) The Department shall offer a special instant
19scratch-off game for the benefit of the Lyme Disease
20Innovation Program, which helps to further education and
21awareness of Lyme disease in Illinois. The game shall commence
22on January 1, 2025 or as soon thereafter, at the discretion of
23the Director, as is reasonably practical. The operation of the
24game shall be governed by this Law and any rules adopted by the
25Department.

1    (b) The net revenue from the Lyme Disease Innovation
2Program scratch-off game shall be deposited into the Lyme
3Disease Awareness Fund.
4    Moneys received for the purposes of this Section,
5including, without limitation, net revenue from the special
6instant scratch-off game and from gifts, grants, and awards
7from any public or private entity, must be deposited into the
8Fund. Any interest earned on moneys in the Fund must be
9deposited into the Fund.
10    As used in this subsection, "net revenue" means the total
11amount for which tickets have been sold less the sum of the
12amount paid out in the prizes and to retailers, and direct and
13estimated administrative expenses of the Department solely
14related to the scratch-off game under this Section.
15    (c) During the time that tickets are sold for the Lyme
16Disease Innovation Program scratch-off game, the Department
17shall not unreasonably diminish the efforts devoted to
18marketing any other instant scratch-off lottery game.
19    (d) The Department may adopt any rules necessary to
20implement and administer the provisions of this Section.
 
21    Section 99. Effective date. This Act takes effect upon
22becoming law.
