Provides that, beginning January 1, 2026, no person may knowingly cause or allow the mixing of a photovoltaic module with municipal waste that is intended for disposal at a landfill. Provides that, beginning January 1, 2026, no person may knowingly cause or allow the disposal of a photovoltaic module in a sanitary landfill. Defines "consumer electronic device" and "photovoltaic module". Effective January 1, 2025. |

1 | | AN ACT concerning safety. |
2 | | Be it enacted by the People of the State of Illinois, |
3 | | represented in the General Assembly: |
4 | | Section 5. The Environmental Protection Act is amended by |
5 | | adding Section 22.23e as follows: |
6 | | (415 ILCS 5/22.23e new) |
7 | | Sec. 22.23e. Photovoltaic modules. |
8 | | (a) As used in this Section: |
9 | | "Consumer electronic device" means any device containing |
10 | | an electronic circuit board that is intended for everyday use |
11 | | by individuals. |
12 | | "Photovoltaic module" means the smallest, nondivisible, |
13 | | environmentally protected assembly of photovoltaic cells or |
14 | | other photovoltaic collector technology, and any ancillary |
15 | | part, intended to generate electrical power under sunlight. |
16 | | "Photovoltaic module" does not include a photovoltaic cell |
17 | | that is part of a consumer electronic device for which it |
18 | | provides electricity needed to make the consumer electronic |
19 | | device function. "Photovoltaic module" includes, but is not |
20 | | limited to, interconnections, terminals, and protective |
21 | | devices, such as diodes, that are: |
22 | | (1) installed on, connected to, or integral to |
23 | | buildings; |
