AMENDMENT TO SENATE BILL 2960

2    AMENDMENT NO. ______. Amend Senate Bill 2960 by replacing
3everything after the enacting clause with the following:
 
4    "Section 1. Short title. This Act may be cited as the Small
5Single-Use Plastic Act.
 
6    Section 5. Definitions. As used in this Act:
7    "Hotel" has the meaning given in the Hotel Operators'
8Occupation Tax Act.
9    "Personal care products" includes shampoo, hair
10conditioner, and bath soap intended to be applied to or used on
11the human body in the shower or bath.
12    "Small, single-use plastic bottle" means a plastic bottle
13or container with less than a 6-ounce capacity that is
14intended to be nonreusable by the end user.
 
15    Section 10. Small, single-use plastic bottles at hotels.

1    (a) Beginning July 1, 2025, a hotel with 50 rooms or more
2shall not provide small, single-use plastic bottles containing
3personal care products in any space within a sleeping room
4accommodation, within bathrooms shared by the public or
5guests, or to a customer of the establishment staying in a
6sleeping room accommodation.
7    (b) Beginning January 1, 2026, a hotel shall not provide
8small, single-use plastic bottles containing personal care
9products in any space within a sleeping room accommodation,
10within bathrooms shared by the public or guests, or to a
11customer of the establishment staying in a sleeping room
12accommodation.
13    (c) A hotel may provide personal care products in small,
14single-use plastic bottles to a person at no cost, upon
15request, at a place other than a sleeping room accommodation,
16a space within the sleeping room accommodation, or a space
17within bathrooms shared by the public or guests.
18    (d) A unit of local government, including a home rule
19unit, shall not regulate the provision of small, single-use
20plastic bottles in a manner inconsistent with the regulation
21by the State of the provision of small, single-use plastic
22bottles under this Act. This Section is a limitation under
23subsection (i) of Section 6 of Article VII of the Illinois
24Constitution on the concurrent exercise by home rule units of
25powers and functions exercised by the State.

1    Section 15. Civil penalties.
2    (a) A hotel in violation of this Act shall receive a
3written warning for the first violation from a State's
4Attorney or a municipal attorney. The written warning shall
5recite the violation and advise that subsequent violations may
6result in citations and penalties. Upon a second or subsequent
7violation, the hotel may be liable for a civil penalty of $500
8for each violation after an action under subsection (b).
9    (b) A State's Attorney or municipal attorney may bring an
10action in circuit court to request a civil penalty, and a
11circuit court may impose a civil penalty under this Section
12against a hotel violating this Act.".
