SYNOPSIS AS INTRODUCED:
 
30 ILCS 105/5.1012 new
625 ILCS 5/3-699.14

    Amends the Illinois Vehicle Code. Allows the issuance of the Illinois USTA/Midwest Tennis Foundation Youth Tennis plate decal by the Illinois USTA/Midwest Tennis Foundation. Creates the Illinois USTA/Midwest Tennis Foundation Youth Tennis Fund. Provides that $25 of each original issuance and $38 of each renewal shall be deposited into the Illinois USTA/Midwest Tennis Foundation Youth Tennis Fund, and that $15 of each original issuance and $2 of each renewal shall be deposited into the Secretary of State Special License Plate Fund. Provides that money in the Illinois USTA/Midwest Tennis Foundation Youth Tennis Fund shall be paid as grants to the Illinois USTA/Midwest Tennis Foundation Youth Tennis to aid USTA/Midwest districts in the State with exposing youth to the game of tennis. Makes a conforming change in the State Finance Act.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The State Finance Act is amended by adding
5Section 5.1012 as follows:
 
6    (30 ILCS 105/5.1012 new)
7    Sec. 5.1012. The Illinois USTA/Midwest Tennis Foundation
8Youth Tennis Fund.
 
9    Section 10. The Illinois Vehicle Code is amended by
10changing Section 3-699.14 as follows:

14    Sec. 3-699.14. Universal special license plates.
15    (a) In addition to any other special license plate, the
16Secretary, upon receipt of all applicable fees and
17applications made in the form prescribed by the Secretary, may
18issue Universal special license plates to residents of
19Illinois on behalf of organizations that have been authorized
20by the General Assembly to issue decals for Universal special
21license plates. Appropriate documentation, as determined by

1the Secretary, shall accompany each application. Authorized
2organizations shall be designated by amendment to this
3Section. When applying for a Universal special license plate
4the applicant shall inform the Secretary of the name of the
5authorized organization from which the applicant will obtain a
6decal to place on the plate. The Secretary shall make a record
7of that organization and that organization shall remain
8affiliated with that plate until the plate is surrendered,
9revoked, or otherwise cancelled. The authorized organization
10may charge a fee to offset the cost of producing and
11distributing the decal, but that fee shall be retained by the
12authorized organization and shall be separate and distinct
13from any registration fees charged by the Secretary. No decal,
14sticker, or other material may be affixed to a Universal
15special license plate other than a decal authorized by the
16General Assembly in this Section or a registration renewal
17sticker. The special plates issued under this Section shall be
18affixed only to passenger vehicles of the first division,
19including motorcycles and autocycles, or motor vehicles of the
20second division weighing not more than 8,000 pounds. Plates
21issued under this Section shall expire according to the
22multi-year procedure under Section 3-414.1 of this Code.
23    (b) The design, color, and format of the Universal special
24license plate shall be wholly within the discretion of the
25Secretary. Universal special license plates are not required
26to designate "Land of Lincoln", as prescribed in subsection

1(b) of Section 3-412 of this Code. The design shall allow for
2the application of a decal to the plate. Organizations
3authorized by the General Assembly to issue decals for
4Universal special license plates shall comply with rules
5adopted by the Secretary governing the requirements for and
6approval of Universal special license plate decals. The
7Secretary may, in his or her discretion, allow Universal
8special license plates to be issued as vanity or personalized
9plates in accordance with Section 3-405.1 of this Code. The
10Secretary of State must make a version of the special
11registration plates authorized under this Section in a form
12appropriate for motorcycles and autocycles.
13    (c) When authorizing a Universal special license plate,
14the General Assembly shall set forth whether an additional fee
15is to be charged for the plate and, if a fee is to be charged,
16the amount of the fee and how the fee is to be distributed.
17When necessary, the authorizing language shall create a
18special fund in the State treasury into which fees may be
19deposited for an authorized Universal special license plate.
20Additional fees may only be charged if the fee is to be paid
21over to a State agency or to a charitable entity that is in
22compliance with the registration and reporting requirements of
23the Charitable Trust Act and the Solicitation for Charity Act.
24Any charitable entity receiving fees for the sale of Universal
25special license plates shall annually provide the Secretary of
26State a letter of compliance issued by the Attorney General

1verifying that the entity is in compliance with the Charitable
2Trust Act and the Solicitation for Charity Act.
3    (d) Upon original issuance and for each registration
4renewal period, in addition to the appropriate registration
5fee, if applicable, the Secretary shall collect any additional
6fees, if required, for issuance of Universal special license
7plates. The fees shall be collected on behalf of the
8organization designated by the applicant when applying for the
9plate. All fees collected shall be transferred to the State
10agency on whose behalf the fees were collected, or paid into
11the special fund designated in the law authorizing the
12organization to issue decals for Universal special license
13plates. All money in the designated fund shall be distributed
14by the Secretary subject to appropriation by the General
15Assembly.
16    (e) The following organizations may issue decals for
17Universal special license plates with the original and renewal
18fees and fee distribution as follows:
19        (1) The Illinois Department of Natural Resources.
20            (A) Original issuance: $25; with $10 to the
21        Roadside Monarch Habitat Fund and $15 to the Secretary
22        of State Special License Plate Fund.
23            (B) Renewal: $25; with $23 to the Roadside Monarch
24        Habitat Fund and $2 to the Secretary of State Special
25        License Plate Fund.
26        (2) Illinois Veterans' Homes.

11    (f) The following funds are created as special funds in
12the State treasury:
13        (1) The Roadside Monarch Habitat Fund. All money in
14    the Roadside Monarch Habitat Fund shall be paid as grants
15    to the Illinois Department of Natural Resources to fund
16    roadside monarch and other pollinator habitat development,
17    enhancement, and restoration projects in this State.
18        (2) The Prostate Cancer Awareness Fund. All money in
19    the Prostate Cancer Awareness Fund shall be paid as grants
20    to the Prostate Cancer Foundation of Chicago.
21        (3) The Horsemen's Council of Illinois Fund. All money
22    in the Horsemen's Council of Illinois Fund shall be paid
23    as grants to the Horsemen's Council of Illinois.
24        (4) The Post-Traumatic Stress Disorder Awareness Fund.
25    All money in the Post-Traumatic Stress Disorder Awareness
26    Fund shall be paid as grants to K9s for Veterans, NFP for

1    support, education, and awareness of veterans with
2    post-traumatic stress disorder.
3        (5) The Guide Dogs of America Fund. All money in the
4    Guide Dogs of America Fund shall be paid as grants to the
5    International Guiding Eyes, Inc., doing business as Guide
6    Dogs of America.
7        (6) The Mechanics Training Fund. All money in the
8    Mechanics Training Fund shall be paid as grants to the
9    Mechanics Local 701 Training Fund.
10        (7) The Theresa Tracy Trot - Illinois CancerCare
11    Foundation Fund. All money in the Theresa Tracy Trot -
12    Illinois CancerCare Foundation Fund shall be paid to the
13    Illinois CancerCare Foundation for the purpose of
14    furthering pancreatic cancer research.
15        (8) The Developmental Disabilities Awareness Fund. All
16    money in the Developmental Disabilities Awareness Fund
17    shall be paid as grants to the Illinois Department of
18    Human Services to fund legal aid groups to assist with
19    guardianship fees for private citizens willing to become
20    guardians for individuals with developmental disabilities
21    but who are unable to pay the legal fees associated with
22    becoming a guardian.
23        (9) The Pediatric Cancer Awareness Fund. All money in
24    the Pediatric Cancer Awareness Fund shall be paid as
25    grants to the Cancer Center at Illinois for pediatric
26    cancer treatment and research.

1        (10) The Folds of Honor Foundation Fund. All money in
2    the Folds of Honor Foundation Fund shall be paid as grants
3    to the Folds of Honor Foundation to aid in providing
4    educational scholarships to military families.
5        (11) The Experimental Aircraft Association Fund. All
6    money in the Experimental Aircraft Association Fund shall
7    be paid, subject to appropriation by the General Assembly
8    and distribution by the Secretary, as grants to promote
9    recreational aviation.
10        (12) The Child Abuse Council of the Quad Cities Fund.
11    All money in the Child Abuse Council of the Quad Cities
12    Fund shall be paid as grants to benefit the Child Abuse
13    Council of the Quad Cities.
14        (13) The Illinois Health Care Workers Benefit Fund.
15    All money in the Illinois Health Care Workers Benefit Fund
16    shall be paid as grants to the Trinity Health Foundation
17    for the benefit of health care workers, doctors, nurses,
18    and others who work in the health care industry in this
19    State.
20        (14) The Future Farmers of America Fund. All money in
21    the Future Farmers of America Fund shall be paid as grants
22    to the Illinois Association of Future Farmers of America.

5        (1) The Roadside Monarch Habitat Fund. All money in

8    roadside monarch and other pollinator habitat development,
9    enhancement, and restoration projects in this State.
10        (2) The Prostate Cancer Awareness Fund. All money in
11    the Prostate Cancer Awareness Fund shall be paid as grants
12    to the Prostate Cancer Foundation of Chicago.
13        (3) The Horsemen's Council of Illinois Fund. All money
14    in the Horsemen's Council of Illinois Fund shall be paid
15    as grants to the Horsemen's Council of Illinois.
16        (4) The Post-Traumatic Stress Disorder Awareness Fund.
17    All money in the Post-Traumatic Stress Disorder Awareness
18    Fund shall be paid as grants to K9s for Veterans, NFP for
19    support, education, and awareness of veterans with
20    post-traumatic stress disorder.
21        (5) The Guide Dogs of America Fund. All money in the
22    Guide Dogs of America Fund shall be paid as grants to the
23    International Guiding Eyes, Inc., doing business as Guide
24    Dogs of America.
25        (6) The Mechanics Training Fund. All money in the
26    Mechanics Training Fund shall be paid as grants to the

1    Mechanics Local 701 Training Fund.
2        (7) The Theresa Tracy Trot - Illinois CancerCare
3    Foundation Fund. All money in the Theresa Tracy Trot -
4    Illinois CancerCare Foundation Fund shall be paid to the
5    Illinois CancerCare Foundation for the purpose of
6    furthering pancreatic cancer research.
7        (8) The Developmental Disabilities Awareness Fund. All
8    money in the Developmental Disabilities Awareness Fund
9    shall be paid as grants to the Illinois Department of
10    Human Services to fund legal aid groups to assist with
11    guardianship fees for private citizens willing to become
12    guardians for individuals with developmental disabilities
13    but who are unable to pay the legal fees associated with
14    becoming a guardian.
15        (9) The Pediatric Cancer Awareness Fund. All money in
16    the Pediatric Cancer Awareness Fund shall be paid as
17    grants to the Cancer Center at Illinois for pediatric
18    cancer treatment and research.
19        (10) The Folds of Honor Foundation Fund. All money in
20    the Folds of Honor Foundation Fund shall be paid as grants
21    to the Folds of Honor Foundation to aid in providing
22    educational scholarships to military families.
23        (11) The Experimental Aircraft Association Fund. All
24    money in the Experimental Aircraft Association Fund shall
25    be paid, subject to appropriation by the General Assembly
26    and distribution by the Secretary, as grants to promote

1    recreational aviation.
2        (12) The Child Abuse Council of the Quad Cities Fund.
3    All money in the Child Abuse Council of the Quad Cities
4    Fund shall be paid as grants to benefit the Child Abuse
5    Council of the Quad Cities.
6        (13) The Illinois Health Care Workers Benefit Fund.
7    All money in the Illinois Health Care Workers Benefit Fund
8    shall be paid as grants to the Trinity Health Foundation
9    for the benefit of health care workers, doctors, nurses,
10    and others who work in the health care industry in this
11    State.
12        (14) The Future Farmers of America Fund. All money in
13    the Future Farmers of America Fund shall be paid as grants
14    to the Illinois Association of Future Farmers of America.
15        (15) The Tick Research, Education, and Evaluation
16    Fund. All money in the Tick Research, Education, and
17    Evaluation Fund shall be paid as grants to the Illinois
18    Lyme Association.
19        (16) The Illinois USTA/Midwest Tennis Foundation Youth
20    Tennis Fund. All money in the Illinois USTA/Midwest Tennis
21    Foundation Youth Tennis Fund shall be paid as grants to
22    the Illinois USTA/Midwest Tennis Foundation Youth Tennis
23    to aid USTA/Midwest districts in the State with exposing
24    youth to the game of tennis.
