SYNOPSIS AS INTRODUCED:
 
20 ILCS 2610/9.5 new
50 ILCS 705/10.8 new

    Amends the Illinois State Police Act and the Illinois Police Training Act. Provides that an applicant's credit history may not be used to prevent the appointment or employment of a law enforcement officer, including an Illinois State Police officer. Provides that the limitation does not apply to employment actions performed under a collective bargaining agreement in effect on the effective date of the amendatory Act. Provides that a collective bargaining agreement that conflicts with the limitation may not be entered into, modified, or extended on or after the effective date of the amendatory Act. Limits home rule powers.

1    AN ACT concerning government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois State Police Act is amended by
5adding Section 9.5 as follows:
 
6    (20 ILCS 2610/9.5 new)
7    Sec. 9.5. Credit history of applicants.
8    (a) An applicant's credit history may not be used to
9prevent the appointment of an Illinois State Police officer.
10    (b) This Section does not apply to employment actions
11performed under a collective bargaining agreement in effect on
12the effective date of this amendatory Act of the 103rd General
13Assembly. A collective bargaining agreement that conflicts
14with subsection (a) may not be entered into, modified, or
15extended on or after the effective date of this amendatory Act
16of the 103rd General Assembly.
 
17    Section 10. The Illinois Police Training Act is amended by
18adding Section 10.8 as follows:

1prevent the employment of a law enforcement officer.
2    (b) This Section does not apply to employment actions
3performed under a collective bargaining agreement in effect on
4the effective date on this amendatory Act of the 103rd General
5Assembly. A collective bargaining agreement that conflicts
6with subsection (a) may not be entered into, modified, or
7extended on or after the effective date of this amendatory Act
8of the 103rd General Assembly.
9    (c) A home rule unit may not take employment actions or
10enter into, modify, or extend collective bargaining agreements
11in a manner inconsistent with this Section. This Section is a
12limitation under subsection (i) of Section 6 of Article VII of
13the Illinois Constitution on the concurrent exercise by home
14rule units of powers and functions exercised by the State.
