AMENDMENT TO SENATE BILL 1211

2    AMENDMENT NO. ______. Amend Senate Bill 1211 by replacing
3everything after the enacting clause with the following:
 
4    "Section 1. Short title. This Act may be cited as the Road
5Designation Program Act.
 
6    Section 5. Purpose. This Act establishes a designation
7program for the naming and subsequent placement of signage
8upon interstate or State-numbered highway interchanges or upon
9bridges or segments of highway under the jurisdiction of the
10Department of Transportation.
 
11    Section 10. Definitions. As used in this Act:
12    "Department" means the Department of Transportation.
13    "Secretary" means the Secretary of the Department of
14Transportation.

1    Section 15. Road designation program.
2    (a) Any person who desires to have an interstate or
3State-numbered highway interchange or bridge or segment of
4highway, not to exceed one mile, under the jurisdiction of the
5Department designated, for an individual who passed away after
61940, shall petition the Department by submitting an
7application in a form prescribed by the Secretary. The form
8shall include the amount of the fee under subsection (b) and
9contain the following:
10        (1) a description of the interstate or State-numbered
11    highway interchange or bridge or segment of highway under
12    the jurisdiction of the Department for which the
13    designation is sought and the proposed name of the
14    interchange, bridge, or relevant segment of highway; and
15        (2) a letter of sponsorship from the State
16    Representative and State Senator for each district in
17    which the road is located.
18    (b) After determining that the petitioner meets all of the
19application requirements of subsection (a), the Department
20shall submit a recommendation containing the proposed
21designations to the sponsors in the General Assembly named in
22the application. The Department shall be notified upon the
23approval or denial of a proposed designation. Upon the
24approval of a proposed designation, the petitioner shall
25submit a fee to be determined by the Secretary to cover the
26costs of constructing and maintaining the proposed signs on

1the interchange, bridge, or segment of highway. The fee shall
2not exceed the cost of constructing and maintaining each sign.
3    (c) The Department shall give notice of any proposed
4designation under this Section and publish a list of all
5current designations on the Department's official public
6website. If a requested area of interstate or State-numbered
7highway interchange or bridge or segment of highway is already
8designated, the Department along with the individual or entity
9requesting the designation shall find a suitable alternative
10location.
11    (d) The honorary signs may be placed upon interstate or
12State-numbered highway interchanges or upon bridges or
13segments of highway under the jurisdiction of the Department
14according to the provisions of this Section, and any
15applicable federal and State limitations or conditions on
16highway signage, including location and spacing.
17    (e) Two signs shall be erected for each interchange,
18bridge, or segment of highway designation processed under this
19Section.
20    (f) No interchange, bridge, or segment of highway may be
21named or designated under this Section if it carries an
22existing designation.
23    (g) All money received by the Department for the
24construction and maintenance of interchange, bridge, or
25segment of highway signs shall be deposited into the Road
26Fund.

1    (h) The documents and fees required under this Section
2shall be submitted to the Department. The Department shall
3waive all fees for road designations made in honor of members
4of the United States Armed Forces and first responders who
5have died in the line of duty.
 
6    Section 99. Effective date. This Act takes effect upon
7becoming law.".
