AMENDMENT TO SENATE BILL 941

2    AMENDMENT NO. ______. Amend Senate Bill 941 by replacing 
3everything after the enacting clause with the following:
 
4    "Section 1. Short title. This Act may be cited as the 
5Automated Telephone Answering Equipment Act.
 
6    Section 5. Use of automated telephone answering equipment. 
7A business that uses automated telephone answering equipment 
8to answer incoming telephone calls shall, during the normal 
9hours of operation of the business, provide the caller with 
10the option of speaking to a live operator.
 
11    Section 10. Limitations.
12    (a) This Act only applies to businesses that employ 50 or 
13more employees and do business in this State.
14    (b) This Act does not apply to lines dedicated to 
15providing general information and any system that is designed

1to permit an individual to conduct a complete transaction with 
2the business over the telephone solely by pressing one or more 
3touch tone telephone keys in response to automated prompts.
 
4    Section 15. Civil penalty. A business that commits a 
5violation of this Act shall be subject to a civil penalty of 
6$10,000 per violation, payable to the Secretary of State. The 
7Attorney General may bring an action in circuit court to 
8enforce a civil penalty assessed under this Section.".
