AMENDMENT TO SENATE BILL 898

2    AMENDMENT NO. ______. Amend Senate Bill 898 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Vehicle Code is amended by
5changing Sections 3-101, 3-111, and 3-111.1 as follows:
 
6    (625 ILCS 5/3-101)  (from Ch. 95 1/2, par. 3-101)
7    Sec. 3-101. Certificate of title required.
8    (a) Except as provided in Section 3-102, every owner of a
9vehicle which is in this State and for which no Illinois
10certificate of title has been issued by the Secretary of State
11shall make application to the Secretary of State for an
12Illinois a certificate of title of the vehicle. Except as
13provided in Section 3-102, every owner of a vehicle that is in
14this State for which no Illinois certificate of title has been
15issued by the Secretary of State and every owner of a vehicle
16that is in the State applying for a duplicate certificate of

1title or a corrected certificate of title, including a dealer
2lien release certificate of title, must make application to
3the Secretary of State for an Illinois duplicate certificate
4of title or corrected certificate of title. Any owner of a
5vehicle in this State with a certificate of title that was
6issued by an entity other than the Secretary of State and
7showing an Illinois address for the owner must be converted to
8an Illinois title before the owner can transfer the vehicle.
9    Under no circumstances shall a dealer required to obtain
10an Illinois certificate of title pursuant to this Code be
11allowed to obtain an out-of-state certificate of title for
12purposes of a vehicle held for sale in this State by the
13dealer. Under no circumstances shall a dealer be allowed to
14obtain an out-of-state certificate of title in lieu of an
15Illinois-issued dealer lien release certificate of title when
16a dealer may have need of such title issuance. Nothing in this
17Section shall be construed so as to allow a dealer to acquire
18an out-of-state certificate of title in lieu of acquiring an
19Illinois certificate of title for purposes of a vehicle held
20for sale in this State by the dealer.
21    (b) Every owner of a motorcycle or motor driven cycle
22purchased new on and after January 1, 1980 shall make
23application to the Secretary of State for a certificate of
24title. However, if such cycle is not properly manufactured or
25equipped for general highway use pursuant to the provisions of
26this Act, it shall not be eligible for license registration,

1but shall be issued a distinctive certificate of title except
2as provided in Sections 3-102 and 3-110 of this Act.
3    (c) The Secretary of State shall not register or renew the
4registration of a vehicle unless a certificate of title has
5been issued by the Secretary of State to the owner or an
6application therefor has been delivered by the owner to the
7Secretary of State.
8    (d) Every owner of an all-terrain vehicle or off-highway
9motorcycle purchased on or after January 1, 1998 shall make
10application to the Secretary of State for a certificate of
11title.
12    (e) Every owner of a low-speed vehicle manufactured after
13January 1, 2010 shall make application to the Secretary of
14State for a certificate of title.

17    Sec. 3-111. Lost, stolen or mutilated certificates. (a) If
18a certificate of title is lost, stolen, mutilated or destroyed
19or becomes illegible, the first lienholder or, if none, the
20owner or legal representative of the owner named in the
21certificate, as shown by the records of the Secretary of
22State, shall promptly make application to the Secretary of
23State for and may obtain a duplicate upon furnishing
24information satisfactory to the Secretary of State. The
25duplicate certificate of title shall contain the legend "This

1is a duplicate certificate and may be subject to the rights of
2a person under the original certificate." It shall be mailed
3to the first lienholder named in it or, if none, to the owner
4or the owner's designee. A certificate of title or a duplicate
5certificate of title issued by another State showing an
6Illinois address for the owner cannot be used to transfer
7ownership of a vehicle.
8    (b) The Secretary of State shall not issue a duplicate
9certificate of title to any person within 15 days after the
10issuance of an original certificate of title to such person.
11    (c) A person recovering an original certificate of title
12for which a duplicate has been issued shall promptly surrender
13the original certificate to the Secretary of State.
14    (d) An application for a duplicate certificate of title
15must state the current vehicle odometer reading at the time of
16application and that the stated odometer reading is one of the
17following: actual mileage, not the actual mileage or mileage
18is in excess of its mechanical limits.
19    (e) If a Display certificate of title is lost, stolen,
20mutilated or destroyed or becomes illegible, the owner or
21legal representative of the owner named in the original
22Display certificate of title and in the certificate of title,
23as shown by the records of the Secretary of State, shall
24promptly make application for and may obtain a duplicate upon
25furnishing information satisfactory to the Secretary of State.
26The duplicate Display certificate of title shall contain the

1legend "Duplicate Display Certificate of Title." It shall be
2mailed to the owner or legal representative of the owner named
3in the original Display certificate of title and in the
4certificate of title. Such duplicate Display certificate of
5title shall be attached and displayed in the same manner and in
6the same place as the original Display certificate of title
7would have been attached and displayed had it not been lost,
8stolen, mutilated or destroyed or had it not become illegible.

11    Sec. 3-111.1. Corrected certificates. An application for a
12corrected certificate of title must state the current vehicle
13odometer reading at the time of application and that the
14stated odometer reading is one of the following: actual
15mileage, not the actual mileage or mileage is in excess of its
16mechanical limits. The corrected certificate issued under this
17Section shall contain the notation "corrected". A certificate
18of title or a corrected certificate of title issued by another
19State showing an Illinois address for the owner cannot be used
20to transfer ownership of a vehicle. The owner of a vehicle with
21a certificate of title or duplicate certificate of title
22issued by another state showing an Illinois address cannot
23transfer ownership of the vehicle without first converting the
24certificate of title to an Illinois certificate of title.
