AMENDMENT TO SENATE BILL 282

2    AMENDMENT NO. ______. Amend Senate Bill 282 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Election Code is amended by changing
5Section 19-2.6 and by adding Section 20-16 as follows:
 
6    (10 ILCS 5/19-2.6)
7    Sec. 19-2.6. Vote by mail; voters with a print disability.
8    (a) Definitions. As used in this Section, unless the
9context otherwise requires:
10    "Assistive technology" means any equipment, software, or
11product used to increase, maintain, or improve the functional
12capabilities of individuals with disabilities, including, but
13not limited to, screen reading and magnification software,
14refreshable Braille displays, and speech recognition programs.
15    "Certified remote accessible vote by mail system" means,
16for elections that occur before the 2024 primary election, a

1process approved by the State Board of Elections through which
2an election authority provides for the electronic transmission
3of a vote by mail ballot to a voter with a print disability and
4through which the voter with a print disability marks and
5verifies the voter's ballot using assistive technology.
6"Certified remote accessible vote by mail system" means, for
7the 2024 primary election and all subsequent elections, a
8process approved by the State Board of Elections through which
9an election authority provides for the electronic transmission
10of a vote by mail ballot to a voter with a print disability and
11through which the voter with a print disability marks,
12verifies, and returns the voter's ballot to the election
13authority electronically using assistive technology.
14    "Electronic transmission" means the transfer of data or
15information through an authorized electronic data interchange
16system.
17    "Voter with a print disability" means a person having a
18temporary or permanent physical or mental impairment, such as
19blindness, low vision, physical dexterity limitations, or
20learning or cognitive disabilities, that prevents the person
21from effective reading, writing, or use of printed material.
22    (b) The State Board of Elections shall provide a certified
23remote accessible vote by mail system for the General Election
24of November 8, 2022 and all subsequent elections that occur
25before the 2024 primary election, through which a vote by mail
26ballot can be delivered by electronic transmission to voters

1with print disabilities and through which voters with print
2disabilities are able to mark and verify their ballots using
3assistive technology.
4    (c) For the November 8, 2022 general election and all
5subsequent elections that occur before the 2024 primary
6election, election Election authorities shall permit voters
7with a print disability to receive and mark their vote by mail
8ballots (i) through the certified remote accessible vote by
9mail system provided by the State Board of Elections pursuant
10to subsection (b) of this Section or (ii) through a certified
11remote accessible vote by mail system provided by the election
12authority.
13    (d) If a vote by mail ballot application from a voter with
14a print disability arrives after the jurisdiction begins
15transmitting vote by mail ballots and instructions to voters,
16the election authority shall electronically transmit the
17ballot, instructions, and balloting materials to the voter
18within two business days after receipt of the application.
19    (e) Ballots received and marked pursuant to subsections
20(b) and (c) of this Section must be printed by the voter and
21returned to the election authority as provided in Section
2219-6.
23    (f) For the 2024 primary election and all subsequent
24elections, the State Board of Elections shall provide a
25certified remote accessible vote by mail system through which
26an election authority can deliver a vote by mail ballot

1through electronic transmission to voters with a print
2disability and through which voters with a print disability
3can mark, verify, and return a vote by mail ballot to the
4election authority electronically.
5    (g) To ensure that voters with a print disability are able
6to complete all aspects of the vote by mail process privately
7and independently, the State Board of Elections shall
8establish a method that allows voters with a print disability
9to electronically authenticate a vote by mail ballot without
10assistance and election authorities shall use that method of
11authentication.
12    (h) All electronic documents and web pages that must be
13used as part of the certified remote accessible vote by mail
14system provided by the State Board of Elections or election
15authorities shall be compliant with the Web Content
16Accessibility Guidelines 2.1 Level AA standards and updated as
17necessary to comply with any subsequent Web Content
18Accessibility Guidelines standards.
19    (i) (f) The State Board of Elections shall adopt rules,
20including emergency rules, necessary for the implementation of
21this Section. The State Board of Elections' adopted rules
22shall include certification standards for a remote accessible
23vote by mail system and a method subject to the provisions in
24Sections 19-2 and 19-3 of this Article by which a voter with a
25print disability may request to use a certified remote
26accessible vote by mail system and apply for an accessible

4    Sec. 20-16. Certified remote accessible vote by mail
5system. An election authority shall provide a certified remote
6accessible vote by mail system that complies with Section
719-2.6, or use the certified remote accessible vote by mail
8system provided by the State Board of Elections under Section
919-2.6, through which a vote by mail ballot can be delivered by
10electronic transmission to any voter eligible to receive a
11vote by mail ballot under this Article and through which a
12voter can mark, verify, and return a vote by mail ballot to the
13election authority electronically. The certified remote
14accessible vote by mail system shall comply with the
15requirements of Section 19-2.6, except subsection (h) of
16Section 19-2.6.
 
17    Section 99. Effective date. This Act takes effect January
181, 2024.".
