AMENDMENT TO SENATE BILL 106

2    AMENDMENT NO. ______. Amend Senate Bill 106 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Procurement Code is amended by
5adding Section 45-110 as follows:
 
6    (30 ILCS 500/45-110 new)
7    Sec. 45-110. Former coal mining employees.
8    (a) In this Section:
9    "Abandoned Mined Land Reclamation Project" means
10construction or construction-related professional services
11that are used for reclamation projects awarded by the
12Department of Natural Resources under the Abandoned Mined
13Lands and Water Reclamation Act.
14    "Former coal mine employee" means an individual who was
15previously employed in any capacity by a coal mining company
16that engaged in the extraction of coal deposits or an

1individual who was previously employed in any capacity by a
2coal-fired power plant.
3    (b) In awarding contracts for Abandoned Mined Land
4Reclamation Projects with a total value of more than $100,000,
5preference shall be given to an otherwise qualified bidder
6who:
7        (1) provides proof that at least 2 current employees
8    of the bidder are former coal mine employees and that all
9    such declared former coal mine employees in the bid shall
10    be used in the fulfillment of an awarded Abandoned Mined
11    Land Reclamation Project; or
12        (2) commits to employing at least 2 former coal mine
13    employees hired from a union in the fulfillment of the
14    abandoned mined reclamation project will provide proof
15    that at least 2 former coal mine employees have been hired
16    from a union within 60 days of the start of construction,
17    and declares that the former coal mine employees after
18    being hired shall be used in the completion of an awarded
19    Abandoned Mined Land Reclamation Project.
20    When the Illinois Department of Natural Resources is to
21award a contract to the lowest responsible bidder, an
22otherwise qualified bidder who will fulfill the contract
23through the use of former coal mine employees may be given
24preference over other bidders unable to do so, if the bid is
25not more than 2% greater than the low bid.
26    (c) This Section does not apply to any contract for any

1project for which federal funds are available for expenditure
2when its provisions may be in conflict with federal law or
3federal regulation.".
