SYNOPSIS AS INTRODUCED:
 
105 ILCS 5/10-22.4  from Ch. 122, par. 10-22.4

    Amends the School Boards Article of the School Code. In provisions concerning the dismissal of teachers, includes releasing student record information to unauthorized parties, engaging in aggressive physical contact with a student or a member of staff if the physical contact does not serve to promote greater safety, and disparaging a student or a member of staff based on protected characteristics as sufficient causes to dismiss a teacher. Effective immediately.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The School Code is amended by changing Section
510-22.4 as follows:
 
6    (105 ILCS 5/10-22.4)  (from Ch. 122, par. 10-22.4)
7    Sec. 10-22.4. Dismissal of teachers. To dismiss a teacher
8for incompetency, cruelty, negligence, immorality, or other
9sufficient cause, including releasing student record
10information to unauthorized parties, engaging in aggressive
11physical contact with a student or a member of staff if the
12physical contact does not serve to promote greater safety, or
13disparaging a student or a member of staff based on protected
14characteristics, to dismiss any teacher on the basis of
15performance, and to dismiss any teacher whenever, in its
16opinion, the teacher he is not qualified to teach, or
17whenever, in its opinion, the interests of the schools require
18it, subject, however, to the provisions of Sections 24-10 to
1924-16.5, inclusive. Temporary mental or physical incapacity to
20perform teaching duties, as found by a medical examination, is
21not a cause for dismissal. Marriage is not a cause of removal.

1    Section 99. Effective date. This Act takes effect upon
2becoming law.
