AMENDMENT TO HOUSE BILL 4804

2    AMENDMENT NO. ______. Amend House Bill 4804 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Environmental Protection Act is amended by
5changing Section 19.11 as follows:
 
6    (415 ILCS 5/19.11)
7    Sec. 19.11. Public water supply disruption; notification.
8    (a) In this Section:
9    "Disruption event" means any:
10        (1) change to a disinfection technique, practice, or
11    technology, including each instance of any change in the
12    concentration of any disinfectant in the water of a public
13    water supply that results in residual concentrations of
14    the disinfectant in the water either exceeding 50% or
15    falling below 20% of the monthly average concentration of
16    disinfectant reported to the Agency in a public water

1    distribution entity's most recent monthly submission of
2    Daily Operating Reports;
3        (2) planned or unplanned work on or damage to a water
4    main or fire hydrant;
5        (3) change in a treatment application or source of
6    water that results in an altered finished water quality;
7        (4) event that results in a public water supply's
8    operating pressure falling below 20 PSI; or
9        (5) condition that results in the issuance of a boil
10    water order.
11    "Disruption notification list" means a list enumerating
12health care facilities, fire departments, dispatch centers,
13and their designees that are served by a public water supply
14and maintained by a public water distribution entity.
15    "Fire department" means a fire protection service provider
16(i) organized under the Illinois Municipal Code or the Fire
17Protection District Act and (ii) recognized by the Office of
18the State Fire Marshal.
19    "Health care facility" means a facility, hospital, or
20establishment licensed or organized under the Ambulatory
21Surgical Treatment Center Act, the University of Illinois
22Hospital Act, the Hospital Licensing Act, the Nursing Home
23Care Act, the Assisted Living and Shared Housing Act, or the
24Community Living Facilities Licensing Act.
25    "Health care facility list" means a list enumerating
26health care facilities and their designees that are served by

1a public water supply and maintained by a public water
2distribution entity.
3    "Public water distribution entity" means any of the
4following entities that are responsible for the direct
5supervision of a public water supply: a municipality, a
6private corporation, an individual private owner, or a
7regularly organized body governed by a constitution and
8by-laws requiring regular election of officers.
9    "Public water supply" has the same meaning as defined in
10Section 3.365.
11    "State agencies" means the Illinois Environmental
12Protection Agency and the Illinois Department of Public
13Health.
14    "Water supply operator" means any individual trained in
15the treatment or distribution of water who has practical,
16working knowledge of the chemical, biological, and physical
17sciences essential to the practical mechanics of water
18treatment or distribution and who is capable of conducting and
19maintaining the water treatment or distribution processes of a
20public water supply in a manner that will provide safe,
21potable water for human consumption.
22    (b) A public water distribution entity, through its
23designated employees or contractors, shall notify its water
24supply operator and all affected health care facilities, fire
25departments, and dispatch centers on the public water supply's
26disruption notification health care facility list not less

1than 14 days before any known, planned, or anticipated
2disruption event. An anticipated disruption event includes for
3purposes of this subsection any disruption event that could or
4should be reasonably anticipated by a public water
5distribution entity.
6    (c) A public water distribution entity, through its
7designated employees or contractors, shall notify its water
8supply operator, and all affected health care facilities, all
9affected fire departments, and all affected dispatch centers
10on a disruption notification list that are served by the
11public water supply and affected by any unplanned disruption
12event in the public water supply's water distribution system.
13The notification required under this subsection shall be
14provided within 2 hours after the public water distribution
15entity becomes aware of the unplanned disruption event.
16    (d) A health care facility, fire department, and dispatch
17center shall designate an email address to receive electronic
18notifications from the public water distribution entity
19concerning planned or unplanned disruption events. The email
20account shall be accessible to the health care facility's
21designated water management plan administrator, the fire
22department's chief officer, the dispatch center's chief
23officer, and other responsible administrative personnel.
24    (e) Any planned or unplanned disruption event notification
25sent to a health care facility, fire department, or dispatch
26center under this Section shall also be sent to the State

1agencies via email to the email addresses designated by the
2State agencies within 5 business days. The State agencies
3shall establish, maintain, and retain a list of notifications
4received pursuant to this subsection.
5    The notice required under this Section shall include, but
6shall not be limited to, the following:
7        (1) a detailed description of the disruption event;
8        (2) the date, time, and location of the disruption
9    event;
10        (3) the expected time needed to resolve the disruption
11    event; and
12        (4) a list of the health care facilities, fire
13    departments, and dispatch centers notified by the public
14    water distribution entity.
15    Beginning one year after the effective date of this
16amendatory Act of the 102nd General Assembly, the State
17agencies shall make available upon request a list of
18disruption events, in an electronic format, sorted by the year
19and month of each occurrence.
20    (f) A public water distribution entity may use contact
21information in its possession, including phone numbers, email
22addresses, and residential addresses, that it obtained before
23or after a planned or an unplanned disruption event in a public
24water supply in order to inform its customers of the
25disruption event, regardless of whether consent is expressly
26given to use the information for that purpose.
