SYNOPSIS AS INTRODUCED:

    Amends the Illinois Identification Card Act. Provides that the Secretary of State shall, subject to appropriation, develop and implement a program to provide a first Illinois Identification Card without cost, during school enrollment, to any child age 12 through 17 who is a resident of the State and is otherwise eligible for an Illinois Identification Card under the Act. Authorizes the Secretary of State to adopt rules necessary to implement the program. Specifies that no fee is to be charged for a first Illinois Identification Card issued to a child through the program. Effective June 1, 2024.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Identification Card Act is amended
5by changing Sections 2 and 12 as follows:
 
6    (15 ILCS 335/2)  (from Ch. 124, par. 22)
7    Sec. 2. Administration and powers and duties of the
8Administrator.
9    (a) The Secretary of State is the Administrator of this
10Act, and he is charged with the duty of observing,
11administering and enforcing the provisions of this Act.
12    (b) The Secretary is vested with the powers and duties for
13the proper administration of this Act as follows:
14        1. He shall organize the administration of this Act as
15    he may deem necessary and appoint such subordinate
16    officers, clerks and other employees as may be necessary.
17        2. From time to time, he may make, amend or rescind
18    rules and regulations as may be in the public interest to
19    implement the Act.
20        3. He may prescribe or provide suitable forms as
21    necessary, including such forms as are necessary to
22    establish that an applicant for an Illinois Person with a
23    Disability Identification Card is a "person with a

1    disability" as defined in Section 4A of this Act, and
2    establish that an applicant for a State identification
3    card is a "homeless person" as defined in Section 1A of
4    this Act.
5        4. He may prepare under the seal of the Secretary of
6    State certified copies of any records utilized under this
7    Act and any such certified copy shall be admissible in any
8    proceeding in any court in like manner as the original
9    thereof.
10        5. Records compiled under this Act shall be maintained
11    for 6 years, but the Secretary may destroy such records
12    with the prior approval of the State Records Commission.
13        6. He shall examine and determine the genuineness,
14    regularity and legality of every application filed with
15    him under this Act, and he may in all cases investigate the
16    same, require additional information or proof or
17    documentation from any applicant.
18        7. He shall require the payment of all fees prescribed
19    in this Act, and all such fees received by him shall be
20    placed in the Road Fund of the State treasury except as
21    otherwise provided in Section 12 of this Act. Whenever any
22    application to the Secretary for an identification card
23    under this Act is accompanied by any fee, as required by
24    law, and the application is denied after a review of
25    eligibility, which may include facial recognition
26    comparison, the applicant shall not be entitled to a

1    refund of any fees paid.
2        8. Beginning July 1, 2017, he shall refuse to issue a
3    REAL ID compliant identification card under this Act to
4    any person who has been issued a REAL ID compliant
5    driver's license under the Illinois Vehicle Code. Any such
6    person may, at his or her discretion, surrender the REAL
7    ID compliant driver's license in order to become eligible
8    to obtain a REAL ID compliant identification card.
9        9. The Secretary may issue both REAL ID compliant
10    identification cards and non-compliant identification
11    cards, and may permit applicants to designate which type
12    of identification card they wish to receive. All
13    provisions of this Act applicable to non-compliant
14    identification cards shall also apply to REAL ID compliant
15    identification cards, except where the provisions are
16    inconsistent with the REAL ID Act and implementing
17    regulations. The Secretary shall establish by rule the
18    date on which issuance of REAL ID compliant identification
19    cards will begin.
20        10. Subject to appropriation, the Secretary of State,
21    as Administrator of this Act, shall develop and implement
22    a program to provide a first Illinois Identification Card
23    without cost, during school enrollment, to any child age
24    12 through 17 who is a resident of this State and is
25    otherwise eligible for an Illinois Identification Card
26    under this Act. The Secretary of State may adopt rules

19the fee for an original, renewal, or duplicate Illinois
20Identification Card issued on or after January 1, 2005; and
21(ii) 80% of the fee for a corrected Illinois Identification
22Card issued on or after January 1, 2005.
23    An individual, who resides in a veterans home or veterans
24hospital operated by the State or federal government, who
25makes an application for an Illinois Identification Card to be
26issued at no fee, must submit, along with the application, an

1affirmation by the applicant on a form provided by the
2Secretary of State, that such person resides in a veterans
3home or veterans hospital operated by the State or federal
4government.
5    The application of a homeless individual for an Illinois
6Identification Card to be issued at no fee must be accompanied
7by an affirmation by a qualified person, as defined in Section
84C of this Act, on a form provided by the Secretary of State,
9that the applicant is currently homeless as defined in Section
101A of this Act.
11    For the application for the first Illinois Identification
12Card of a youth for whom the Department of Children and Family
13Services is legally responsible or a foster child to be issued
14at no fee, the youth must submit, along with the application,
15an affirmation by his or her court appointed attorney or an
16employee of the Department of Children and Family Services on
17a form provided by the Secretary of State, that the person is a
18youth for whom the Department of Children and Family Services
19is legally responsible or a foster child.
20    The fee for any duplicate identification card shall be
21waived for any person who presents the Secretary of State's
22Office with a police report showing that his or her
23identification card was stolen.
24    The fee for any duplicate identification card shall be
25waived for any person age 60 or older whose identification
26card has been lost or stolen.

1    As used in this Section, "active-duty member of the United
2States Armed Forces" means a member of the Armed Services or
3Reserve Forces of the United States or a member of the Illinois
4National Guard who is called to active duty pursuant to an
5executive order of the President of the United States, an act
6of the Congress of the United States, or an order of the
7Governor.

11    Section 99. Effective date. This Act takes effect June 1,
122024.
