2023 and 2024 HB4615 Introduced 1/31/2024, by Rep. Lance Yednock SYNOPSIS AS INTRODUCED: | | | Amends the Campground Licensing and Recreational Area Act. Provides that a licensed campground that installs or permits the installation of one or more hot tubs on a deck on or after the effective date of the amendatory Act shall ensure that (i) the deck is made of acceptable material, (ii) an architect licensed under the Illinois Architecture Practice Act of 1989 or a structural engineer licensed under the Structural Engineering Practice Act of 1989 was responsible for coordinating the design, planning, and creation of specifications for the deck and for applying for a permit for the construction or major alteration, and (iii) the deck was constructed in accordance with the designs, plans, and specifications created by the architect or structural engineer. Provides that "acceptable material" includes wood, composite materials made to resemble wood, or any other material providing similar structural integrity and weight-bearing capabilities. Defines "hot tub". |

2 | | Be it enacted by the People of the State of Illinois, |
3 | | represented in the General Assembly: |
4 | | Section 5. The Campground Licensing and Recreational Area |
5 | | Act is amended by adding Section 4.5 as follows: |
6 | | (210 ILCS 95/4.5 new) |
7 | | Sec. 4.5. Hot tubs on decks. |
8 | | (a) In this Section: |
9 | | "Acceptable material" includes wood, composite materials |
10 | | made to resemble wood, or any other material providing similar |
11 | | structural integrity and weight-bearing capabilities. |
12 | | "Hot tub" means an artificial container of water that is |
13 | | purchased, designed, and manufactured for recreational use in |
14 | | which one or more people can soak in heated water, which may |
15 | | contain mechanisms allowing for direction and adjustment of |
16 | | jets of warm water flowing in a rapidly rotating and circular |
17 | | current. "Hot tub" includes, but is not limited to, tubs that |
18 | | are commonly called "spas", "whirlpools", "hydrotherapy |
19 | | pools", and "hot spas". |
20 | | (b) A licensed campground that installs or permits the |
21 | | installation of one or more hot tubs on a deck on or after the |
22 | | effective date of this amendatory Act of the 103rd General |
23 | | Assembly shall ensure that (i) the deck is made of acceptable |
