A BILL FOR

HB4409LRB103 35995 RLC 66082 b

1    AN ACT concerning criminal law.

2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:

4    Section 5. The Illinois Crime Reduction Act of 2009 is
5amended by changing Section 20 as follows:

6    (730 ILCS 190/20)
7    Sec. 20. Adult Redeploy Illinois.
8    (a) Purpose. When offenders are accurately assessed for
9risk, assets, and needs, it is possible to identify which
10people should be sent to prison and which people can be
11effectively supervised in the locality. By providing financial
12incentives to counties or judicial circuits to create
13effective local-level evidence-based services, it is possible
14to reduce crime and recidivism at a lower cost to taxpayers.
15Based on this model, this Act hereby creates the Adult
16Redeploy Illinois program for probation-eligible offenders in
17order to increase public safety and encourage the successful
18local supervision of eligible offenders and their
19reintegration into the locality.
20    (b) The Adult Redeploy Illinois program shall reallocate
21State funds to local jurisdictions that successfully establish
22a process to assess offenders and provide a continuum of
23locally based sanctions and treatment alternatives for

HB4409- 2 -LRB103 35995 RLC 66082 b

1offenders who would be incarcerated in a State facility if
2those local services and sanctions did not exist. The
3allotment of funds shall be based on a formula that rewards
4local jurisdictions for the establishment or expansion of
5local supervision programs and requires them to pay the amount
6determined in subsection (e) if incarceration targets as
7defined in subsection (e) are not met.
8    (c) Each county or circuit participating in the Adult
9Redeploy Illinois program shall create a local plan describing
10how it will protect public safety and reduce the county or
11circuit's utilization of incarceration in State facilities or
12local county jails by the creation or expansion of
13individualized services or programs.
14    (d) Based on the local plan, a county or circuit shall
15enter into an agreement with the Adult Redeploy Oversight
16Board described in subsection (e) to reduce the number of
17commitments of probation-eligible offenders to State
18correctional facilities from that county or circuit. The
19agreement shall include a pledge from the county or circuit to
20reduce their commitments by 25% of the level of commitments
21from the average number of commitments for the past 3 years of
22eligible offenders. In return, the county or circuit shall
23receive, based upon a formula described in subsection (e),
24funds to redeploy for local programming for offenders who
25would otherwise be incarcerated such as management and
26supervision, electronic monitoring, and drug testing. The

3commitments stipulated in the agreement.

5Justice Information Authority, the Adult Redeploy Illinois
