SYNOPSIS AS INTRODUCED:
 
New Act

    Creates the Low-Carbon Distribution and Delivery Act. Designates residentially zoned areas in counties with a population of 3,000,000 or more as low-carbon delivery zones. Requires a last-mile delivery to a low-carbon delivery zone to be made using a low-carbon delivery method. Requires the Department of Transportation to establish a Low-Carbon Fleet Rebate Program. Provides that the Program shall offer a qualifying purchaser a grant up to 50% toward the purchase of an electric-assist cargo bicycle. Provides that the Program shall offer increased grant incentives of an additional 25% of the purchase amount for the purchase of an electric-assist cargo bicycle that will deliver goods within a low-carbon delivery area that is also designated as an equity investment eligible community. Limits a grant provided under the Program to a maximum award of 75% of the purchase price per electric-assist cargo bicycle. Provides that multiple bicycles may be included in each grant under Program. Allows the Department to limit the amount or number of grants awarded to each qualifying purchaser. Requires a fleet owner to be domiciled in the State. Requires an electric-assist cargo bicycle that acquired using grants from the Program to operate exclusively within the State. Limits the concurrent exercise of home-rule powers. Defines terms.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title. This Act may be cited as the
5Low-Carbon Delivery and Distribution Act.
 
6    Section 5. Definitions. As used in the Act:
7    "Electric-assist cargo bicycle" means a bicycle with 2 or
83 wheels, a saddle, fully operative pedals for human
9propulsion, and an electric motor.
10    "Equity investment eligible communities" has the meaning
11given to that term in the Energy Transition Act.
12    "Last-mile delivery" means the movement of goods from a
13transportation hub to the final delivery destination.
14"Last-mile delivery" does not include the delivery of
15furniture, appliance, or other large item not suitable for
16utilizing a low-carbon delivery method.
17    "Program" means the Low-Carbon Fleet Rebate Program.
18    "Qualifying purchaser" means the fleet or owner who will
19operate or manage the vehicle for a minimum period that shall
20be designated by the Department of Transportation. The
21qualifying purchaser must be a newly formed business entity
22that is not a subsidiary of a parent organization that has a
23gross annual revenue of $20,000,000 or more.

1    Section 10. Low-carbon delivery zone; last-mile
2deliveries. In a county with a population of 3,000,000 or
3more, any residentially zoned area shall be designated as a
4low-carbon delivery zone for the purposes of this Act.
5    A last-mile delivery to a low-carbon delivery zone shall
6be made using a low-carbon delivery method, including, but not
7limited to, bicycles, electric-assist cargo bicycles, electric
8vehicles, or mopeds.
 
9    Section 15. Rebate and incentive program.
10    (a) The Department of Transportation shall establish a
11Low-Carbon Fleet Rebate Program to provide a fleet owner in
12the State grants to promote and implement the requirements of
13this Act. The Program shall offer a qualifying purchaser a
14grant up to 50% of the purchase price for the purchase of an
15electric-assist cargo bicycle.
16    (b) The Program shall offer increased grant incentives of
17an additional 25% of the purchase amount for the purchase of an
18electric-assist cargo bicycle that will deliver goods within a
19low-carbon delivery area that is also designated as an equity
20investment eligible community.
21    (c) A grant provided under the Program is limited to a
22maximum award of 75% of the purchase price per electric-assist
23cargo bicycle. Multiple bicycles may be included in each grant
24under Program, however, the Department shall have the

1authority to implement a limit on the amount or number of
2grants awarded to each qualifying purchaser.
3    (d) A fleet owner must be domiciled in this State.
4    (e) An electric-assist cargo bicycle acquired using grants
5from the Program must operate exclusively within this State.
 
6    Section 20. Rules. The Secretary of Transportation shall
7adopt rules to implement this Act.
 
8    Section 25. Home Rule. A home rule municipality may not
9regulate last-mile deliveries to low-carbon delivery zones in
10a manner inconsistent with this Section. This Section is a
11limitation under subsection (i) of Section 6 of Article VII of
12the Illinois Constitution on the concurrent exercise by home
13rule units of powers and functions exercised by the State.
