Requires a contractor or person employed to deliver goods from a store or restaurant through a third-party delivery service to use a non-carbon emitting mode of transportation while making such deliveries. Provides that a contractor or person who fails to comply with the provisions may be subject to a fine of $250 or suspension of the contractor's or person's driving privileges. Restricts the provisions to counties with a population of 3,000,000 or more. Limits the concurrent exercise of home rule powers. |

1 | | AN ACT concerning transportation. |
2 | | Be it enacted by the People of the State of Illinois, |
3 | | represented in the General Assembly: |
4 | | Section 5. The Illinois Vehicle Code is amended by adding |
5 | | Section 11-1433 as follows: |
6 | | (625 ILCS 5/11-1433 new) |
7 | | Sec. 11-1433. Third-party delivery service; zero-emission |
8 | | deliveries. |
9 | | (a) As used in this Section, "third-party delivery |
10 | | service" has the meaning given to that term under the Fair Food |
11 | | and Retail Delivery Act. |
12 | | (b) A contractor or person employed to deliver goods from |
13 | | a store or restaurant through a third-party delivery service |
14 | | shall use a non-carbon emitting mode of transportation while |
15 | | making such deliveries. |
16 | | (c) A contractor or person that violates this Section may |
17 | | be subject to a fine of $250 or suspension of the contractor's |
18 | | or person's driver's license. |
19 | | (d) This Section shall only apply to counties with a |
20 | | population of 3,000,000 or more. |
21 | | (e) A home rule municipality may not regulate deliveries |
22 | | pertaining to third-party delivery services in a manner |
23 | | inconsistent with this Section. This Section is a limitation |
