SYNOPSIS AS INTRODUCED:

410 ILCS 705/55-105 new

    Amends the Cannabis Regulation and Tax Act. Provides that the mayor or president of the board of trustees of each city, village, or incorporated town and the president or chairman of the county board shall be the local cannabis control commissioner for his or her respective city, village, incorporated town, or county. Provides that the mayor, president of the board of trustees, or president or chairman of the county board may appoint a person or persons to assist him or her in the exercise of the powers and the performance of the duties of the local cannabis control commissioner. Provides for the powers, functions, and duties of a local cannabis control commissioner, including the power to recommend to the relevant Department that a license issued to a person within his or her jurisdiction be suspended or revoked for cause and to enter or to authorize any law enforcement officer to enter at any time upon any premises licensed under the Act to determine whether any of the provisions of the Act or any rules or regulations have been or are being violated, to examine the premises of a licensee, and to receive complaints from any citizen within the local cannabis control commissioner's jurisdiction.

1    AN ACT concerning health.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Cannabis Regulation and Tax Act is amended
5by adding Sections 55-100 and 55-105 as follows:
 
6    (410 ILCS 705/55-100 new)
7    Sec. 55-100. Local cannabis control commissioner. The
8mayor or president of the board of trustees of each city,
9village, or incorporated town, or his or her designee, and the
10president or chairman of the county board, or his or her
11designee, shall be the local cannabis control commissioner for
12his or her respective city, village, incorporated town, or
13county and shall be charged with the administration in his or
14her respective jurisdiction of the appropriate provisions of
15this Act and of ordinances and resolutions relating to
16cannabis as may be enacted. The authority of the president or
17chairman of the county board, or his or her designee, shall
18extend only to that area in any county that lies outside the
19corporate limit of any city, village, and incorporated town in
20the county and those areas that are owned by the county and are
21within the corporate limits of a city, village, and
22incorporated town with a population of less than 1,000,000.

1president or chairman of the county board, or his or her
2designee, may appoint a person or persons to assist him or her
3in the exercise of the powers and the performance of the duties
4of the local cannabis control commissioner.

6    Sec. 55-105. Powers, functions, and duties of a local
7cannabis control commissioner. Each local cannabis control
8commissioner shall have the following powers, functions, and
9duties with respect to licenses issued under this Act:
10        (1) to recommend to the relevant Department that a
11    license issued to a person within his or her jurisdiction
12    be suspended or revoked for cause;
13        (2) to enter or to authorize any law enforcement
14    officer to enter at any time upon any premises licensed
15    under this Act to determine whether any of the provisions
16    of this Act or any rules or regulations adopted by him or
17    her or by the applicable Department have been or are being
18    violated, and at such time to examine the premises of the
19    licensee; and
20        (3) to receive a complaint from any citizen within his
21    or her jurisdiction that any provision of this Act or any
22    rule adopted under this Act has been or is being violated
23    and to act upon the complaint in a manner provided by law.
