SYNOPSIS AS INTRODUCED:
 
305 ILCS 5/5-47 new

    Amends the Administration Article of the Illinois Public Aid Code. Provides that subject to appropriation, the Department of Human Services shall replace SNAP benefits that were stolen from a recipient's electronic benefits transfer card by means of card skimming, card cloning, or some other similar fraudulent method during the period October 1, 2022 through September 30, 2026. Provides that the Department may adopt any rules necessary to implement the amendatory Act, including rules on how to accept and substantiate recipient claims for SNAP benefits stolen by means of card skimming, card cloning, or some other similar fraudulent method. Provides that the amendatory Act is repealed on January 1, 2027. Effective immediately.

1    AN ACT concerning public aid.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Public Aid Code is amended by
5adding Section 5-47 as follows:
 
6    (305 ILCS 5/5-47 new)
7    Sec. 5-47. Stolen SNAP benefits replacement.
8    (a) As used in this Section, "electronic benefits transfer
9card" means the LINK card issued by the Department of Human
10Services for the purpose of enabling a user of the card to
11obtain Supplemental Nutrition Assistance Program (SNAP)
12benefits or cash.
13    (b) Subject to appropriation, the Department of Human
14Services shall replace SNAP benefits that were stolen from a
15recipient's electronic benefits transfer card by means of card
16skimming, card cloning, or some other similar fraudulent
17method during the period October 1, 2022 through September 30,
182026. The Department may adopt any rules necessary to
19implement this provision, including rules on how to accept and
20substantiate recipient claims for SNAP benefits stolen by
21means of card skimming, card cloning, or some other similar
22fraudulent method. This Section is repealed on January 1,
232027.

1    Section 99. Effective date. This Act takes effect upon
2becoming law.
