    Amends the Vital Records Act. Provides that preparation of a certificate of stillbirth is required after a fetal death that occurs in this State after a gestation period of at least 20 (rather than 26) completed weeks.

1    AN ACT concerning health.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Vital Records Act is amended by changing
5Section 20.5 as follows:
 
6    (410 ILCS 535/20.5)
7    Sec. 20.5. Certificate of stillbirth.
8    (a) The State Registrar shall prescribe and distribute a
9form for a certificate of stillbirth. The certificate shall be
10in the same format as a certificate of live birth prepared
11under Section 12 and shall be filed in the same manner as a
12certificate of live birth.
13    (b) After each fetal death that occurs in this State after
14a gestation period of at least 20 26 completed weeks, the
15person who files a fetal death certificate in connection with
16that death as required under Section 20 shall, only upon
17request by the woman who delivered the stillborn fetus, also
18prepare a certificate of stillbirth. The person shall prepare
19the certificate on the form prescribed and furnished by the
20State Registrar and in accordance with the rules adopted by
21the State Registrar.
22    (c) If the stillborn's parent or parents do not wish to
23provide a name for the stillborn, the person who prepares the

1certificate of stillbirth shall leave blank any references to
2the stillborn's name.
3    (d) When a stillbirth occurs in this State and the
4stillbirth has not been registered within one year after the
5delivery, a certificate marked "delayed" may be filed and
6registered in accordance with regulations adopted by the State
7Registrar. The certificate must show on its face the date of
8registration.
9    (e) In the case of a fetal death that occurred in this
10State after a gestation period of at least 26 completed weeks
11and before the effective date of this amendatory Act of the
1293rd General Assembly, a parent of the stillborn child may
13request that the person who filed a fetal death certificate in
14connection with that death as required under Section 20 shall
15also prepare a certificate of stillbirth with respect to the
16fetus. If a parent of a stillborn makes such a request under
17this subsection (e), the person who filed a fetal death
18certificate shall prepare the certificate of stillbirth and
19file it with the designated registrar within 30 days after the
20request by the parent.
