SYNOPSIS AS INTRODUCED:
 
65 ILCS 5/8-4-27 new

    Amends the Illinois Municipal Code. Creates the Municipal Water and Wastewater Funding Study Committee. Provides that the Committee shall study and make recommendations concerning any needed modifications to Illinois Environmental Protection Agency and Illinois Pollution Control Board regulations and policies as they relate to municipal water and wastewater funding to ensure that the State's revolving loan fund programs account for and prioritize the following, to the fullest extent allowed by federal law: (1) a community shall not be deemed ineligible for disadvantaged community status based on size or service area of any size, with regard to special rates, loan terms, and eligibility for loan or grant funds; (2) in determining whether a community is disadvantaged, consideration should be given to impacts of funding on water and wastewater expenses for low-income populations; (3) in determining whether a community is eligible for funds and special rates or loan terms, environmental justice concepts should be considered; (4) in determining how funding is allocated, a community facing water supply shortages should be considered a high priority based on urgency of need; (5) the funding programs should promote formation and implementation of regional water partnerships; and (6) targeted funding should be provided for addressing emerging contaminants, including PFAS. Includes provisions concerning Committee membership and a report of the Committee's findings due no later than January 31, 2023. Repeals the provisions on January 1, 2024. Effective immediately.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Municipal Code is amended by
5adding Section 8-4-27 as follows:
 
6    (65 ILCS 5/8-4-27 new)
7    Sec. 8-4-27. Municipal Water and Wastewater Funding Study
8Committee.
9    (a) The Municipal Water and Wastewater Funding Study
10Committee is established.
11    (b) The following members shall be appointed to the
12Committee no later than 30 days after the effective date of
13this amendatory Act of the 102nd General Assembly:
14        (1) Two members appointed by the President of the
15    Senate.
16        (2) Two members appointed by the Minority Leader of
17    the Senate.
18        (3) Two members appointed by the Speaker of the House
19    of Representatives.
20        (4) Two members appointed by the Minority Leader of
21    the House of Representatives.
22        (5) Two members appointed by the Governor.
23The members shall elect from their number a chair and such

1other officers as they may choose. The Committee shall meet at
2the call of the chair. Committee members shall serve without
3compensation. If a vacancy occurs in the Committee membership,
4the vacancy shall be filled in the same manner as the original
5appointment for the remainder of the Committee.
6    (c) The Committee shall study and make recommendations
7concerning any needed modifications to Illinois Environmental
8Protection Agency and Illinois Pollution Control Board
9regulations and policies as they relate to municipal water and
10wastewater funding to ensure that the State's revolving loan
11fund programs account for and prioritize the following, to the
12fullest extent allowed by federal law:
13        (1) A community shall not be deemed ineligible for
14    disadvantaged community status based on size or service
15    area of any size, with regard to special rates, loan
16    terms, and eligibility for loan or grant funds.
17        (2) In determining whether a community is
18    disadvantaged, consideration should be given to impacts of
19    funding on water and wastewater expenses for low-income
20    populations.
21        (3) In determining whether a community is eligible for
22    funds and special rates or loan terms, environmental
23    justice concepts should be considered.
24        (4) In determining how funding is allocated, a
25    community facing water supply shortages should be
26    considered a high priority based on urgency of need.

1        (5) The funding programs should promote formation and
2    implementation of regional water partnerships.
3        (6) Targeted funding should be provided for addressing
4    emerging contaminants, including PFAS.
5    (d) The Committee shall prepare a report that summarizes
6its work and makes recommendations resulting from its study.
7The Committee shall submit the report of its findings and
8recommendations to the Governor and the General Assembly no
9later than January 31, 2023. Once the Committee has submitted
10the report to the General Assembly and Governor, the Committee
11is dissolved.
12    (f) This Section is repealed on January 1, 2024.
 
13    Section 99. Effective date. This Act takes effect upon
14becoming law.
