AMENDMENT TO SENATE BILL 658

2    AMENDMENT NO. ______. Amend Senate Bill 658 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Emergency Telephone System Act is amended
5by changing Section 3 as follows:
 
6    (50 ILCS 750/3)  (from Ch. 134, par. 33)
7    (Section scheduled to be repealed on December 31, 2023)
8    Sec. 3. (a) By July 1, 2017, every local public agency
9shall be within the jurisdiction of a 9-1-1 system.
10    (b) Within 18 months of the awarding of a contract to a
11vendor certified under Section 13-900 of the Public Utilities
12Act to provide Next Generation 9-1-1 service, every 9-1-1
13system in Illinois, except in a municipality with a population
14over 500,000, shall provide Next Generation 9-1-1 service. A
15municipality with a population over 500,000 shall provide Next
16Generation 9-1-1 service by December 31, 2023.

1    Notwithstanding any provision of the Illinois Municipal
2Code, a 9-1-1 vendor under Section 13-900 of the Public
3Utilities Act must give written notice to the municipality it
4has a contract with or for which it currently provides
5emergency services not less than 12 months prior to
6termination of services. If an emergency services contract is
7terminated, the provider may not increase the fees of any
8remaining contract by more than 3% of the fees from the
9previous year. A private sector company that terminates the
10emergency services contract prior to the natural expiration of
11the contract term and that seeks an increase in the annual
12contract value of more than 10% is barred from contracting
13with any units of local government or entities that receive
14funding for emergency services for a period of 5 years from the
15date of the notice of contract termination. As used in this
16paragraph, "emergency services" includes, but is not limited
17to, dispatch, 9-1-1, paramedic, or ambulance services.
18    (c) Nothing in this Act shall be construed to prohibit or
19discourage in any way the formation of multijurisdictional or
20regional systems, and any system established pursuant to this
21Act may include the territory of more than one public agency or
22may include a segment of the territory of a public agency.

24    Section 10. The Emergency Medical Services (EMS) Systems
25Act is amended by adding Section 3.260 as follows:

1    (210 ILCS 50/3.260 new)
2    Sec. 3.260. Contracts with municipalities. Notwithstanding
3any provision of the Illinois Municipal Code, a 9-1-1 vendor
4under Section 13-900 of the Public Utilities Act must give
5written notice to the municipality it has a contract with or
6for which it currently provides emergency services not less
7than 12 months prior to termination of services. If an
8emergency services contract is terminated, the provider may
9not increase the fees of any remaining contract by more than 3%
10of the fees from the previous year. A private sector company
11that terminates the emergency services contract prior to the
12natural expiration of the contract term and that seeks an
13increase in the annual contract value of more than 10% is
14barred from contracting with any units of local government or
15entities that receive funding for emergency services for a
16period of 5 years from the date of the notice of contract
17termination.
18    As used in this Section, "emergency services" includes,
19but is not limited to, dispatch, 9-1-1, paramedic, or
20ambulance services.
 
21    Section 99. Effective date. This Act takes effect upon
22becoming law.".
