1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Aeronautics Act is amended by
5changing Section 38.01 as follows:
 
6    (620 ILCS 5/38.01)  (from Ch. 15 1/2, par. 22.38a)
7    Sec. 38.01. Project applications.
8    (a) No municipality or or political subdivision in this
9state, whether acting alone or jointly with another
10municipality or political subdivision or with the state, shall
11submit any project application under the provisions of the
12Airport and Airway Improvement Act of 1982, or any amendment
13thereof, unless the project and the project application have
14been first approved by the Department. No such municipality or
15political subdivision shall directly accept, receive, or
16disburse any funds granted by the United States under the
17Airport and Airway Improvement Act of 1982, but it shall
18designate the Department as its agent to accept, receive, and
19disburse such funds, provided, however, nothing in this
20Section shall be construed to prohibit any municipality or any
21political subdivision of more than 500,000 inhabitants from
22disbursing such funds through its corporate authorities. It
23shall enter into an agreement with the Department prescribing

1the terms and conditions of such agency in accordance with
2federal laws, rules and regulations and applicable laws of
3this state. This subsection (a) does not apply to any project
4application submitted in connection with the O'Hare
5Modernization Program as defined in Section 10 of the O'Hare
6Modernization Act.
7    (b) The City of Chicago may submit a project application
8under the provisions of the Airport and Airway Improvement Act
9of 1982, as now or hereafter amended, or any other federal law
10providing for airport planning or development, if the
11application is submitted in connection with the O'Hare
12Modernization Program as defined in Section 10 of the O'Hare
13Modernization Act, and the City may directly accept, receive,
14and disburse any such funds.
