AMENDMENT TO SENATE BILL 317

2    AMENDMENT NO. ______. Amend Senate Bill 317 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Promotion Act is amended by
5changing Sections 3, 4, 8a, and 13 as follows:
 
6    (20 ILCS 665/3)  (from Ch. 127, par. 200-23)
7    Sec. 3. Definitions. The following words and terms,
8whenever used or referred to in this Act, shall have the
9following meanings, except where the context may otherwise
10require:
11    (a) "Department" means the Department of Commerce and
12Economic Opportunity of the State of Illinois.
13    (b) "Local promotion group" means any non-profit
14corporation, organization, association, agency or committee
15thereof formed for the primary purpose of publicizing,
16promoting, advertising or otherwise encouraging the

1development of tourism in any municipality, county, or region
2of Illinois.
3    (c) "Promotional activities" means preparing, planning and
4conducting campaigns of information, advertising and publicity
5through such media as newspapers, radio, television,
6magazines, trade journals, moving and still photography,
7posters, outdoor signboards and personal contact within and
8without the State of Illinois; dissemination of information,
9advertising, publicity, photographs and other literature and
10material designed to carry out the purpose of this Act; and
11participation in and attendance at meetings and conventions
12concerned primarily with tourism, including travel to and from
13such meetings.
14    (d) "Municipality" means "municipality" as defined in
15Section 1-1-2 of the Illinois Municipal Code, as heretofore
16and hereafter amended.
17    (e) "Tourism" means travel 50 miles or more one-way or an
18overnight trip outside of a person's normal routine.
19    (f) "Municipal amateur sports facility" means a sports
20facility that: (1) is owned by a unit of local government; (2)
21has contiguous indoor sports competition space; (3) is
22designed to principally accommodate and host amateur
23competitions for youths, adults, or both; and (4) is not used
24for professional sporting events where participants are
25compensated for their participation.
26    (g) "Municipal convention center" means a convention

1center or civic center owned by a unit of local government or
2operated by a convention center authority, or a municipal
3convention hall as defined in paragraph (1) of Section 11-65-1
4of the Illinois Municipal Code, with contiguous exhibition
5space ranging between 30,000 and 125,000 square feet.
6    (h) "Convention center authority" means an Authority, as
7defined by the Civic Center Code, that operates a municipal
8convention center with contiguous exhibition space ranging
9between 30,000 and 125,000 square feet.
10    (i) "Incentive" means: (1) a financial incentive provided
11by a unit of local government or convention center authority
12to attract a convention, meeting, or trade show held at a
13municipal convention center that, but for the incentive, would
14not have occurred in the State or been retained in the State;
15or (2) a financial incentive provided by a unit of local
16government for attracting a sporting event held at its
17municipal amateur sports facility that, but for the incentive,
18would not have occurred in the State or been retained in the
19State; but (3) only a financial incentive offered or provided
20to a person or entity in the form of financial benefits or
21costs which are allowable costs pursuant to the Grant
22Accountability and Transparency Act.
23    (j) "Unit of local government" has the meaning provided in
24Section 1 of Article VII of the Illinois Constitution.
25    (k) "Local parks" means any park, recreation area, or
26other similar facility owned or operated by a unit of local

4    Sec. 4. Powers. The Department shall have the following
5powers:
6    (a) To formulate a program for the promotion of tourism
7and the film industry in the State of Illinois, including, but
8not limited to, the promotion of our State Parks and local
9parks, fishing and hunting areas, historical shrines, vacation
10regions and areas of historic or scenic interest.
11    (b) To cooperate with civic groups and local, State and
12federal departments and agencies, and agencies and departments
13of other states in encouraging educational tourism and
14developing programs therefor.
15    (c) To publish tourist promotional material such as
16brochures and booklets.
17    (d) To promote tourism in Illinois through all media,
18including but not limited to, the Internet, television,
19articles and advertisements in magazines, newspapers and
20travel publications and by establishing promotional
21exhibitions at fairs, travel shows, and similar exhibitions.
22    (e) To establish and maintain travel offices at major
23points of entry to the State.
24    (f) To recommend legislation relating to the encouragement
25of tourism in Illinois.

1    (g) To assist municipalities, other units of local
2government, or local promotion groups in developing new
3tourist attractions including but not limited to feasibility
4studies and analyses, research and development, and management
5and marketing planning for such new tourist attractions.
6    (h) (Blank).
7    (i) To implement a program of matching grants and loans to
8counties, municipalities, other units of local government,
9local promotion groups and others, as provided in Sections 5
10and 8a of this Act, for the development or improvement of
11tourism attractions and tourism events in Illinois under the
12terms and conditions provided in this Act.
13    (j) To expend funds from the International and Promotional
14Fund, subject to appropriation, on any activity authorized
15under this Act.
16    (k) To do any other acts that, in the judgment of the
17Department, are necessary and proper in fostering and
18promoting tourism in the State of Illinois.

21    Sec. 8a. Tourism grants and loans.
22    (1) The Department is authorized to make grants and loans,
23subject to appropriations by the General Assembly for this
24purpose from the Tourism Promotion Fund, to counties,
25municipalities, other units of local government, local

1promotion groups, not-for-profit organizations, or for-profit
2businesses for the development or improvement of tourism
3attractions in Illinois. Individual grants and loans shall not
4exceed $1,000,000 and shall not exceed 50% of the entire
5amount of the actual expenditures for the development or
6improvement of a tourist attraction. Agreements for loans made
7by the Department pursuant to this subsection may contain
8provisions regarding term, interest rate, security as may be
9required by the Department and any other provisions the
10Department may require to protect the State's interest.

14    Sec. 13. Powers of municipalities and counties. For the
15purposes set out in this Act, the corporate authorities of
16each city, village or incorporated town and the county board
17of each county may (1) promote the advantages of the
18municipality or county, as the case may be, for tourism,
19industrial development and other activities and programs
20designed to stimulate employment, (2) appropriate funds for
21promotional activities and programs, (3) accept gifts and
22grants to be used for promotional purposes, and (4) join with
23other municipalities, counties, other units of local
24government, and local promotion groups in promotional
25activities and programs.
