1    AN ACT concerning finance.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Procurement Code is amended by
5changing Section 55-20 as follows:
 
6    (30 ILCS 500/55-20)
7    Sec. 55-20. Contracts for food donation; food donation
8policy.
9    (a) After the effective date of this amendatory Act of the
1099th General Assembly, a public entity shall not enter into a
11contract to purchase food with a bidder or offeror if the
12bidder's or offeror's contract terms prohibit the public
13entity from donating food to food banks, including, but not
14limited to, homeless shelters, food pantries, and soup
15kitchens.
16    (b) Each State agency that purchases food through a
17contract procured in accordance with entering into or
18maintaining a contract for the purchase of food under this
19Code shall adopt a policy that permits the donation of
20leftover food purchased with procured by State funds. The
21policy shall address any daily food operations run by the
22agency, including one-time events, and shall contain a list of
23nearby soup kitchens, food pantries, and other non-profit

1organizations where leftover food can be donated. Each State
2agency shall circulate its policy to all agency employees, and
3submit its food donation policy to the Department of Central
4Management Services on an annual basis beginning December 31,
52018.

7    Section 99. Effective date. This Act takes effect upon
