SYNOPSIS AS INTRODUCED:

    Amends the Illinois Procurement Code. Strikes a provision requiring the Department of Central Management Services to report to the General Assembly on specified annual reports produced by each State agency. Provides that each State agency that purchases food through a contract procured in accordance with the Code shall adopt a policy that permits the donation of leftover food purchased with State funds. Effective immediately.

1    AN ACT concerning finance.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Procurement Code is amended by
5changing Sections 25-55 and 55-20 as follows:
 
6    (30 ILCS 500/25-55)
7    Sec. 25-55. Annual reports. Every printed annual report
8produced by a State agency shall bear a statement indicating
9whether it was printed by the State of Illinois or by contract
10and indicating the printing cost per copy and the number of
11copies printed. The Department of Central Management Services
12shall prepare and submit to the General Assembly on the fourth
13Wednesday of January in each year a report setting forth with
14respect to each State agency for the calendar year immediately
15preceding the calendar year in which the report is filed the
16total quantity of annual reports printed, the total cost, and
17the cost per copy and the cost per page of the annual report of
18the State agency printed during the calendar year covered by
19the report.

1policy.
2    (a) After the effective date of this amendatory Act of the
399th General Assembly, a public entity shall not enter into a
4contract to purchase food with a bidder or offeror if the
5bidder's or offeror's contract terms prohibit the public
6entity from donating food to food banks, including, but not
7limited to, homeless shelters, food pantries, and soup
8kitchens.
9    (b) Each State agency that purchases food through a
10contract procured in accordance with entering into or
11maintaining a contract for the purchase of food under this
12Code shall adopt a policy that permits the donation of
13leftover food purchased with procured by State funds. The
14policy shall address any daily food operations run by the
15agency, including one-time events, and shall contain a list of
16nearby soup kitchens, food pantries, and other non-profit
17organizations where leftover food can be donated. Each State
18agency shall circulate its policy to all agency employees, and
19submit its food donation policy to the Department of Central
20Management Services on an annual basis beginning December 31,

23    Section 99. Effective date. This Act takes effect upon
