AMENDMENT TO HOUSE BILL 5358

2    AMENDMENT NO. ______. Amend House Bill 5358 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The State Finance Act is amended by adding
5Section 5.970 as follows:
 
6    (30 ILCS 105/5.970 new)
7    Sec. 5.970. The Illinois Trucking Grant Pilot Program
8Fund. This Section is repealed on December 31, 2027.
 
9    Section 10. The Higher Education Student Assistance Act is
10amended by adding Section 65.120 as follows:
 
11    (110 ILCS 947/65.120 new)
12    Sec. 65.120. Illinois Trucking Grant Pilot Program Fund.
13    (a) Subject to appropriation, beginning with awards for
14the 2023-2024 academic year, the Commission shall establish

1the Illinois Trucking Grant Pilot Program and receive and
2consider applications for grant assistance under this Section.
3The purpose of the Illinois Trucking Grant Pilot Program is to
4provide financial assistance to individuals that are accepted
5to enroll in a truck driver training program at a public
6community college that prepares a student to obtain a Class A
7commercial driver's license in the State.
8    (b) An applicant is eligible for a grant under this
9Section if the Commission finds that the applicant:
10        (1) is a resident of this State;
11        (2) has been accepted to enroll in a truck driver
12    training program at a public community college that
13    prepares a student to obtain a Class A commercial driver's
14    license in the State;
15        (3) is a high school graduate or has earned a high
16    school equivalency degree; and
17        (4) meets all other admissions criteria for the truck
18    driver training program or course at the community college
19    in which the applicant is enrolled.
20    (c) Applicants who are determined to be eligible for
21assistance under this Section shall receive, subject to
22appropriation, a grant sufficient to pay for the tuition and
23fees for a truck driver training program at a public community
24college. All grant payments shall be paid directly to the
25community college at which the applicant is enrolled.
26    (d) A grant awarded under this Section may not be renewed

1and may not exceed $5,000 per award per recipient.
2    (e) Any person who has accepted a grant under this Section
3must, within one year after completing a truck driver training
4program at a public community college, begin working as a
5licensed truck driver employed in this State and continue to
6work as a licensed truck driver in this State for at least one
7year.
8    (f) If a recipient of a grant awarded under this Section
9fails to fulfill the work obligation set forth in subsection
10(e) of this Section, the Commission shall require the
11recipient to repay the amount of the grant received, prorated
12according to the fraction of the work obligation not
13completed, at a rate of interest equal to 5%, and, if
14applicable, reasonable collection fees. The Commission is
15authorized to establish rules relating to its collection
16activities for the repayment of grants under this Section. All
17repayments collected under this Section shall be forwarded to
18the State Comptroller for deposit into the State's General
19Revenue Fund.
20    (g) The Illinois Trucking Grant Pilot Program Fund is
21created as a special fund in the State treasury. All money in
22this Fund may be used, subject to appropriation, by the
23Commission for operational expenses associated with the
24administration of the Illinois Trucking Grant Pilot Program
25and for the payment of costs associated with providing grants
26to eligible community colleges in accordance with the Illinois

1Trucking Grant Pilot Program.
2    The Fund may also receive grants, awards, endowments, or
3like proceeds and, if appropriate, other funds made available
4through contracts with governmental, public, and private
5agencies or persons.
6    (h) The Commission shall make all necessary and proper
7rules not inconsistent with this Section for its effective
8implementation.
9    (i) This Section is repealed on December 31, 2027.".
