    Amends the Metropolitan Transit Authority Act, the Local Mass Transit District Act, the Regional Transportation Authority Act, and the Illinois Vehicle Code. Eliminates provisions conditioning the eligibility of a person 65 years of age or older or a person with a disability for the waiver or reduction of certain fees and charges upon income eligibility limitations. Effective January 1, 2023.

1    AN ACT concerning the waiver or reduction of certain fees
2and charges.
 
3    Be it enacted by the People of the State of Illinois,
4represented in the General Assembly:
 
5    Section 5. The Metropolitan Transit Authority Act is
6amended by changing Sections 51 and 52 as follows:

8    Sec. 51. Free services; eligibility. Beginning January 1,
92023 (a) Notwithstanding any law to the contrary, no later
10than 60 days following the effective date of this amendatory
11Act of the 95th General Assembly and until subsection (b) is
12implemented, any fixed route public transportation services
13provided by, or under grant or purchase of service contracts
14of, the Board shall be provided without charge to all senior
15citizens of the Metropolitan Region (as "Metropolitan Region"
16such term is defined in Section 70 ILCS 3615/ 1.03 of the
17Regional Transportation Authority Act) aged 65 and older,
18under such conditions as shall be prescribed by the Board.
19    (b) Notwithstanding any law to the contrary, no later than
20180 days following the effective date of this amendatory Act
21of the 96th General Assembly, any fixed route public
22transportation services provided by, or under grant or
23purchase of service contracts of, the Board shall be provided

1without charge to senior citizens aged 65 and older who meet
2the income eligibility limitation set forth in subsection
3(a-5) of Section 4 of the Senior Citizens and Persons with
4Disabilities Property Tax Relief Act, under such conditions as
5shall be prescribed by the Board. The Department on Aging
6shall furnish all information reasonably necessary to
7determine eligibility, including updated lists of individuals
8who are eligible for services without charge under this
9Section. Nothing in this Section shall relieve the Board from
10providing reduced fares as may be required by federal law.

4    Section 10. The Local Mass Transit District Act is amended
5by changing Sections 8.6 and 8.7 as follows:

7    Sec. 8.6. Free services; eligibility. Beginning January 1,
82023 (a) Notwithstanding any law to the contrary, no later
9than 60 days following the effective date of this amendatory
10Act of the 95th General Assembly and until subsection (b) is
11implemented, any fixed route public transportation services
12provided by, or under grant or purchase of service contracts
13of, every District shall be provided without charge to all
14senior citizens of the District aged 65 and older, under such
15conditions as shall be prescribed by the District.
16    (b) Notwithstanding any law to the contrary, no later than
17180 days following the effective date of this amendatory Act
18of the 96th General Assembly, any fixed route public
19transportation services provided by, or under grant or
20purchase of service contracts of, every District shall be
21provided without charge to senior citizens aged 65 and older
22who meet the income eligibility limitation set forth in
23subsection (a-5) of Section 4 of the Senior Citizens and
24Persons with Disabilities Property Tax Relief Act, under such

1conditions as shall be prescribed by the District. The
2Department on Aging shall furnish all information reasonably
3necessary to determine eligibility, including updated lists of
4individuals who are eligible for services without charge under
5this Section. Nothing in this Section shall relieve the
6District from providing reduced fares as may be required by
7federal law.

1    Section 15. The Regional Transportation Authority Act is
2amended by changing Sections 3A.15, 3A.16, 3B.14, and 3B.15 as
3follows:

5    Sec. 3A.15. Free services; eligibility.
6    Beginning January 1, 2023 (a) Notwithstanding any law to
7the contrary, no later than 60 days following the effective
8date of this amendatory Act of the 95th General Assembly and
9until subsection (b) is implemented, any fixed route public
10transportation services provided by, or under grant or
11purchase of service contracts of, the Suburban Bus Board shall
12be provided without charge to all senior citizens of the
13Metropolitan Region aged 65 and older, under such conditions
14as shall be prescribed by the Suburban Bus Board.
15    (b) Notwithstanding any law to the contrary, no later than
16180 days following the effective date of this amendatory Act
17of the 96th General Assembly, any fixed route public
18transportation services provided by, or under grant or
19purchase of service contracts of, the Suburban Bus Board shall
20be provided without charge to senior citizens aged 65 and
21older who meet the income eligibility limitation set forth in
22subsection (a-5) of Section 4 of the Senior Citizens and
23Persons with Disabilities Property Tax Relief Act, under such
24conditions as shall be prescribed by the Suburban Bus Board.

2    Sec. 3B.14. Free services; eligibility. Beginning January
31, 2023 (a) Notwithstanding any law to the contrary, no later
4than 60 days following the effective date of this amendatory
5Act of the 95th General Assembly and until subsection (b) is
6implemented, any fixed route public transportation services
7provided by, or under grant or purchase of service contracts
8of, the Commuter Rail Board shall be provided without charge
9to all senior citizens of the Metropolitan Region aged 65 and
10older, under such conditions as shall be prescribed by the
11Commuter Rail Board.
12    (b) Notwithstanding any law to the contrary, no later than
13180 days following the effective date of this amendatory Act
14of the 96th General Assembly, any fixed route public
15transportation services provided by, or under grant or
16purchase of service contracts of, the Commuter Rail Board
17shall be provided without charge to senior citizens aged 65
18and older who meet the income eligibility limitation set forth
19in subsection (a-5) of Section 4 of the Senior Citizens and
20Persons with Disabilities Property Tax Relief Act, under such
21conditions as shall be prescribed by the Commuter Rail Board.
22The Department on Aging shall furnish all information
23reasonably necessary to determine eligibility, including
24updated lists of individuals who are eligible for services
25without charge under this Section. Nothing in this Section
26shall relieve the Commuter Rail Board from providing reduced

4    Sec. 3B.15. Transit services for individuals with

18services without charge under this Section.

20    Section 20. The Illinois Vehicle Code is amended by adding
21Section 3-806.10 as follows:
 
22    (625 ILCS 5/3-806.10 new)
23    Sec. 3-806.10. Fee reduction or waiver eligibility.

1Notwithstanding any other provision of law, beginning with the
2next registration year after the effective date of this
3amendatory Act of the 102nd General Assembly, if a provision
4of Section 3-609, 3-623, 3-626, 3-667, 3-683, 3-806.3, or
511-1301.2 conditions the eligibility of a person 65 years of
6age or older or a person with a disability for a waiver or
7reduction of a fee or charge upon approval for benefits or a
8grant under the Senior Citizens and Persons with Disabilities
9Property Tax Relief Act, no income eligibility limitation
10shall apply and a person who meets all other applicable
11requirements for the waiver or reduction shall be granted the
12waiver or reduction without regard to the person's income.
 
13    Section 99. Effective date. This Act takes effect January
141, 2023.
