AMENDMENT TO HOUSE BILL 4988

2    AMENDMENT NO. ______. Amend House Bill 4988, AS AMENDED,
3by replacing everything after the enacting clause with the
4following:
 
5    "Section 5. The Environmental Protection Act is amended by
6adding Section 19.11 as follows:
 
7    (415 ILCS 5/19.11 new)
8    Sec. 19.11. Public water supply disruption; notification.
9    (a) In this Section:
10    "Disruption event" means any:
11        (1) change to a disinfection technique, practice, or
12    technology that could change disinfectant levels in the
13    water within a public water supply that results in a
14    residual disinfectant level 20% above or below normal
15    operating levels;
16        (2) planned or unplanned work on or damage to a water

1    main;
2        (3) change in a treatment application or source of
3    water that results in an altered finished water quality;
4        (4) event that results in a public water supply's
5    operating pressure falling below 20 PSI; or
6        (5) condition that results in the issuance of a boil
7    water order.
8    "Health care facility" means a facility, hospital, or
9establishment licensed or organized under the Ambulatory
10Surgical Treatment Center Act, the University of Illinois
11Hospital Act, the Hospital Licensing Act, the Nursing Home
12Care Act, the Assisted Living and Shared Housing Act, or the
13Community Living Facilities Licensing Act.
14    "Health care facility list" means a list enumerating
15health care facilities and their designees that are served by
16a public water supply and maintained by a public water
17distribution entity.
18    "Public water distribution entity" means any of the
19following entities that are responsible for the direct
20supervision of a public water supply: a municipality, a
21private corporation, an individual private owner, or a
22regularly organized body governed by a constitution and
23by-laws requiring regular election of officers.
24    "Public water supply" has the same meaning as defined in
25Section 3.365.
26    "State agencies" means the Illinois Environmental

1Protection Agency and the Illinois Department of Public
2Health.
3    "Water supply operator" means any individual trained in
4the treatment or distribution of water who has practical,
5working knowledge of the chemical, biological, and physical
6sciences essential to the practical mechanics of water
7treatment or distribution and who is capable of conducting and
8maintaining the water treatment or distribution processes of a
9public water supply in a manner that will provide safe,
10potable water for human consumption.
11    (b) A public water distribution entity, through its
12designated employees or contractors, shall notify its water
13supply operator and all affected health care facilities on the
14public water supply's health care facility list not less than
1514 days before any known, planned, or anticipated disruption
16event. An anticipated disruption event includes for purposes
17of this subsection any disruption event that could or should
18be reasonably anticipated by a public water distribution
19entity.
20    (c) A public water distribution entity, through its
21designated employees or contractors, shall notify its water
22supply operator and all affected health care facilities that
23are served by the public water supply and affected by any
24unplanned disruption event in the public water supply's water
25distribution system. The notification required under this
26subsection shall be provided within 2 hours after the public

1water distribution entity becomes aware of the unplanned
2disruption event.
3    (d) A health care facility shall designate an email
4address to receive electronic notifications from the public
5water distribution entity concerning planned or unplanned
6disruption events. The email account shall be accessible to
7the health care facility's designated water management plan
8administrator and other responsible administrative personnel.
9    (e) Any planned or unplanned disruption event notification
10sent to a health care facility under this Section shall also be
11sent to the State agencies via email to the email addresses
12designated by the State agencies within 5 business days. The
13State agencies shall establish, maintain, and retain a list of
14notifications received pursuant to this subsection.
15    The notice required under this Section shall include, but
16shall not be limited to, the following:
17        (1) a detailed description of the disruption event;
18        (2) the date, time, and location of the disruption
19    event;
20        (3) the expected time needed to resolve the disruption
21    event; and
22        (4) a list of the health care facilities notified by
23    the public water distribution entity.
24    Beginning one year after the effective date of this
25amendatory Act of the 102nd General Assembly, the State
26agencies shall make available upon request a list of

1disruption events, in an electronic format, sorted by the year
2and month of each occurrence.
 
3    Section 99. Effective date. This Act takes effect upon
4becoming law.".
