AMENDMENT TO HOUSE BILL 4423

2    AMENDMENT NO. ______. Amend House Bill 4423 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Public Aid Code is amended by
5changing Sections 4-1.6 as follows:
 
6    (305 ILCS 5/4-1.6)  (from Ch. 23, par. 4-1.6)
7    Sec. 4-1.6. Need. Income available to the family as
8defined by the Illinois Department by rule, or to the child in
9the case of a child removed from his or her home, when added to
10contributions in money, substance or services from other
11sources, including income available from parents absent from
12the home or from a stepparent, contributions made for the
13benefit of the parent or other persons necessary to provide
14care and supervision to the child, and contributions from
15legally responsible relatives, must be equal to or less than
16the grant amount established by Department regulation for such

1a person. For purposes of eligibility for aid under this
2Article, the Department shall (a) disregard all earned income
3between the grant amount and 50% of the Federal Poverty Level
4and (b) disregard the value of all assets held by the family.
5    In considering income to be taken into account,
6consideration shall be given to any expenses reasonably
7attributable to the earning of such income. Three-fourths of
8the earned income of a household eligible for aid under this
9Article shall be disregarded when determining the level of
10assistance for which a household is eligible. All The first
11$100 of child support, whether it be current support, past
12support owed, or future support, that is collected on behalf
13of a family in a month for one child and the first $200 of
14child support collected on behalf of a family in a month for 2
15or more children shall be passed through to the family and
16disregarded in determining the amount of the assistance grant
17provided to the family under this Article. Any amount of child
18support that would be disregarded in determining the amount of
19the assistance grant shall be disregarded in determining
20eligibility for cash assistance provided under this Article.
21The Illinois Department may also permit all or any portion of
22earned or other income to be set aside for the future
23identifiable needs of a child. The Illinois Department may
24provide by rule and regulation for the exemptions thus
25permitted or required. The eligibility of any applicant for or
26recipient of public aid under this Article is not affected by

1the payment of any grant under the "Senior Citizens and
2Persons with Disabilities Property Tax Relief Act" or any
3distributions or items of income described under subparagraph
4(X) of paragraph (2) of subsection (a) of Section 203 of the
5Illinois Income Tax Act.
6    The Illinois Department may, by rule, set forth criteria
7under which an assistance unit is ineligible for cash
8assistance under this Article for a specified number of months
9due to the receipt of a lump sum payment.
