AMENDMENT TO HOUSE BILL 4414

2    AMENDMENT NO. ______. Amend House Bill 4414 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Expressway Camera Act is amended by
5changing Sections 5 and 90 as follows:
 
6    (605 ILCS 140/5)
7    (Section scheduled to be repealed on July 1, 2023)
8    Sec. 5. Camera program.
9    (a) The Illinois State Police, the Illinois Department of
10Transportation, and the Illinois State Toll Highway Authority
11shall work together to conduct a program to increase the
12amount of cameras along expressways and the State highway
13system in the counties of Boone, Bureau, Champaign, Cook,
14DeKalb, DuPage, Grundy, Henry, Kane, Kendall, Lake, LaSalle,
15Macon, Madison, McHenry, Morgan, Peoria, Sangamon, St. Clair,
16Will, and Winnebago Cook County.

1    (b) Images from the cameras may be used by any municipal
2police department, county sheriff's office, State Police
3officer, or other law enforcement agency with jurisdiction
4over the expressway in Cook County in the investigation of any
5offense involving the use of a firearm and to detect
6expressway hazards. Images from the cameras shall not be used
7to enforce petty offenses.
8    (c) Subject to appropriation, any funds needed to conduct
9the program for use on expressways under the jurisdiction of
10the Department of Transportation shall be taken from the Road
11Fund. Any funds needed to conduct the program for use on
12expressways under the jurisdiction of the Illinois State Toll
13Highway Authority shall be paid for by funds from the Illinois
14State Tollway Highway Authority.
15    (d) As used in this Section, "expressway" has the meaning
16provided in Section 1-119.3 of the Illinois Vehicle Code.
