AMENDMENT TO HOUSE BILL 4384

2    AMENDMENT NO. ______. Amend House Bill 4384 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Procurement Code is amended by
5adding Section 30-60 as follows:
 
6    (30 ILCS 500/30-60 new)
7    Sec. 30-60. Change order reports.
8    (a) During the period described in subsection (b), the
9Capital Development Board and the Department of Transportation
10shall each prepare quarterly reports on the status of change
11order requests concerning price that have been received by
12either the Board or the Department and that have not been acted
13upon within 45 days. The reports shall be made available to the
14public on the Internet websites of the Capital Development
15Board and the Department of Transportation, and shall also be
16submitted to the Governor and the General Assembly. The

1reports shall include as much information as possible,
2including, but not limited to: (i) the number of change order
3requests concerning price that have been received by the Board
4or the Department within the applicable reporting quarter and
5have not been acted upon within 45 days after their receipt;
6and (ii) for those change order requests concerning price that
7are agreed to by the Board or the Department, information on
8the number of days that passed between the date the change
9order request was received and the date it was agreed to by the
10Board or Department.
11    (b) There shall be 12 quarterly reports in total. The
12first report shall be published on or before January 15, 2023,
13and the last report shall be published on or before December
1415, 2025.
15    (c) The reports may include a narrative section that
16explains any internal improvements made and any plans to
17reduce the number of contracts with a change order in which an
18agreement on price is not reached within 45 days after receipt
19of the change order request.
20    (d) This Section is repealed on January 1, 2026.
 
21    Section 99. Effective date. This Act takes effect upon
22becoming law.".
