SYNOPSIS AS INTRODUCED:
 
415 ILCS 5/9.18 new

    Amends the Environmental Protection Act. Prohibits the disposal by incineration of aqueous film-forming foam that contains perfluoroalkyl and polyfluoroalkyl substances in an area of environmental justice concern. Permits the Environmental Protection Agency to adopt rules it deems necessary to carry out the provisions. Effective immediately.

1    AN ACT concerning safety.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Environmental Protection Act is amended by
5adding Section 9.18 as follows:
 
6    (415 ILCS 5/9.18 new)
7    Sec. 9.18. Perfluoroalkyl and polyfluoroalkyl substances.
8    (a) In this Section:
9    "Incineration" includes, but is not limited to, burning,
10combustion, pyrolysis, gasification, thermal oxidation
11(including flameless and regenerative), acid recovery furnace
12or oxidizer, ore roaster, cement kiln, lightweight aggregate
13kiln, industrial furnace, boiler, and process heater.
14    "Perfluoroalkyl and polyfluoroalkyl substances" means a
15class of fluorinated organic chemicals containing at least one
16fully fluorinated carbon atom.
17    (b) The disposal by incineration of aqueous film-forming
18foam that contains perfluoroalkyl and polyfluoroalkyl
19substances is prohibited in an area of environmental justice
20concern.
21    (c) The Agency may adopt rules it deems necessary to carry
22out the provisions of this Section.

1    Section 99. Effective date. This Act takes effect upon
2becoming law.
