SYNOPSIS AS INTRODUCED:
 
405 ILCS 30/4.3

    Amends the Community Services Act. Removes language requiring the Department of Human Services to establish a Family Support Services Voucher Pilot Program and instead requires the Department to coordinate and fund the Voucher Respite Program. Provides that the Voucher Respite Program shall be a subset of specified programs with the exception that administration of the Program shall not be limited to agencies that provide respite services. Provides that the purpose of the Program is to increase the number of families who are able to access respite services; provide families with greater flexibility over services; and prevent or delay the need for more intensive long-term care and support. Makes other conforming changes. Effective July 1, 2021.

1    AN ACT concerning mental health.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Community Services Act is amended by
5changing Section 4.3 as follows:
 
6    (405 ILCS 30/4.3)
7    Sec. 4.3. Voucher Respite Program Family Support Services
8Voucher Pilot Program.
9    (a) In this Section:
10    "Family member" means a family member as defined by rules
11adopted by the Department of Human Services.
12    "Voucher respite services" "Family support services" means
13the services and activities described in subsection (d).
14    (b) The Department of Human Services shall coordinate and
15fund the establish a Family Support Services Voucher Respite
16Pilot Program which shall be a subset conversion of the
17programs program defined in Section 4.1 with the exception
18that administration of the Voucher Respite Program shall not
19be limited to agencies that provide respite services. The
20Voucher Respite Program may be administered by entities
21meeting the standards outlined by the Department. The
22Department shall establish Voucher Respite contracts with
23community entities throughout the State in order to meet the

1service needs of families. The Department may establish no
2more than 5 pilot programs.
3    (c) The purpose of the Voucher Respite Program the pilot
4program is to do the following:
5        (1) Increase the number of families who are able to
6    access respite family support services.
7        (2) Provide families with greater flexibility control
8    over family support services.
9        (3) Ensure that the diverse family support services
10    needs of families can be accommodated.
11        (4) Prevent or delay the need for more intensive
12    long-term care and support. Encourage a family's
13    contribution toward payment for the family support
14    services they receive.
15        (5) (Blank). Serve as a pilot program to evaluate the
16    merits of a family support services voucher program in
17    comparison to the traditional respite program.
18    (d) The Department shall contract with community entities
19agencies to issue vouchers to participating families, or to
20employ a voucher-like method that similarly makes services
21available based on the choice of families. A family may use the
22vouchers to purchase the following services and activities or
23to otherwise provide for those services and activities:
24        (1) Services of an in-home caregiver to supervise the
25    family member with a developmental disability in the home
26    or in the community or both when other family members are

1    not present.
2        (2) Services of a person to accompany the family
3    member with a developmental disability on outings,
4    community activities, and similar activities.
5        (3) Registration of the family member with a
6    developmental disability in park district programs,
7    extracurricular school activities, community college
8    classes, and other similar types of community-based
9    programs.
10        (4) Services of home health care personnel if medical
11    training or expertise is required to meet the needs of the
12    family member with a developmental disability.
13    (e) Families may employ the following types of individuals
14to provide family support services:
15        (1) Related family members who do not reside in the
16    same home as the family member with a developmental
17    disability.
18        (2) Friends or neighbors whom the family designates as
19    capable of meeting the needs of the family member with a
20    developmental disability.
21        (3) Individuals recruited from the community (for
22    example, church members or college students).
23        (4) Individuals who work with the family member with a
24    developmental disability in a different capacity (for
25    example, classroom aide or day program staff).
26        (5) Persons whose services are contracted for through

1    a home health agency licensed under the Home Health, Home
2    Services, and Home Nursing Agency Licensing Act.
3    (f) Voucher respite services Family support services
4moneys under the pilot program may not be used to purchase or
5provide for any of the following services or activities:
6        (1) Out-of-home medical services.
7        (2) Medical, therapeutic, or developmental
8    evaluations.
9        (3) Any product or item (for example, sports
10    equipment, therapeutic devices, or clothing).
11        (4) Respite Family support services provided by a
12    family member whose primary residence is the same as that
13    of the family member with a developmental disability.
14        (5) Services of a person to accompany the family on an
15    overnight trip.
16        (6) Any service or activity that should be provided by
17    the school in which the family member with a developmental
18    disability is enrolled or that occurs as part of that
19    school's typical school routine.
20        (7) Child care services while the primary caretaker
21    works.
22    (g) (Blank) The Department of Human Services shall submit
23a report to the General Assembly by March 1, 2000 evaluating
24the merits of the pilot program.
