AMENDMENT TO HOUSE BILL 3956 




2    AMENDMENT NO. ______. Amend House Bill 3956 by replacing 
3everything after the enacting clause with the following:

 
4    "Section 5. The Circuit Court Clerk Regulation Act is 
5amended  by changing Section 1 as follows:
 



6    (705 ILCS 110/1)  (from Ch. 37, par. 328)



7    Sec. 1. 
It shall be unlawful for any clerk or deputy clerk 
8of a circuit
court to prepare or draft any document which is to 
9be filed or recorded in
the court in which he or she is clerk 
10or deputy clerk, except such documents as
such clerks are by 
11statute or supreme court order law required, or by some 
12statute authorized to draft or
prepare; and that it shall be 
13unlawful for any such clerk or deputy clerk
to act as an 
14administrator, executor or guardian, or to act as
a trustee by 
15appointment (of any court of which he or she is clerk or deputy

16clerk) or of the last will of any person who is not a family

the clerk or deputy clerk.

2    For purposes of this Section, "family member" shall mean a 
3spouse; child,
natural or adopted; parent; brother; or sister 
4of the clerk or deputy clerk.
