1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title. This Act may be cited as the
5Student Parent Data Collection Act.
 
6    Section 5. Definitions. In this Act:
7    "Parent" means the parent or legal guardian of a child who
8is under the age of 18 years.
9    "Public institution of higher education" or "institution"
10means a public community college or public university in this
11State.
 
12    Section 10. Student parent data collection.
13    (a) The Board of Higher Education, in consultation with
14the Illinois Community College Board, public institutions of
15higher education, and advocates, shall prepare a question or
16questions to be placed on one or more forms that are used by an
17institution on an annual basis to collect demographic data
18from its students for the purpose of determining the parental
19status or legal guardian status of each of its enrolled
20students.
21    (b) The data collected under subsection (a) must be
22disaggregated by all variables collected normally, including,

1but not limited to, the student's race, ethnicity, income,
2gender, age, enrollment status, type of credential sought,
3receipt of financial aid, grade point average, persistence
4toward a degree or credential, and completion outcomes.
 
5    Section 15. Campus child care. Beginning September 1,
62021, each public institution of higher education that
7operates one or more child care centers or early learning
8centers on its campus or is otherwise affiliated with a child
9care center or early learning center shall collect all of the
10following information:
11        (1) The total number of children who are served by
12    each child care center or early learning center per
13    semester.
14        (2) The number of children of students who are
15    enrolled at the institution who are served by each child
16    care center or early learning center per semester.
 
17    Section 20. Reporting requirements.
18    (a) On or before July 1, 2022 and annually thereafter,
19each public university shall report the data collected under
20Sections 10 and 15 to the Board of Higher Education, and each
21public community college shall report the data collected under
22Sections 10 and 15 to the Illinois Community College Board.
23    (b) Each institution, the Board of Higher Education, and
24the Illinois Community College Board shall make the data

1reported under subsection (a) publicly available annually on
2their Internet websites.
3    (c) The Board of Higher Education and the Illinois
4Community College Board, in consultation with public
5institutions of higher education and advocates, may adopt
6rules concerning the reporting of data to protect student
7privacy while satisfying the requirements of this Act.
 
8    Section 25. Family Educational Rights and Privacy Act of
91974. The sharing and reporting of data under this Act must be
10in accordance with the requirements of the federal Family
11Educational Rights and Privacy Act of 1974. Nothing in this
12Act supersedes the federal Family Educational Rights and
13Privacy Act of 1974 or rules adopted pursuant to the federal
14Family Educational Rights and Privacy Act of 1974 or any
15federal or State laws and rules governing student privacy
16rights.
 
17    Section 99. Effective date. This Act takes effect July 1,
182021.
