AMENDMENT TO HOUSE BILL 1776

2    AMENDMENT NO. ______. Amend House Bill 1776 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. If and only if Senate Bill 1510 of the 101st
5General Assembly becomes law, then the Illinois Public Aid
6Code is amended by changing Section 5-5.07 as follows:
 
7    (305 ILCS 5/5-5.07)
8    Sec. 5-5.07. Inpatient psychiatric stay; DCFS per diem
9rate. The Department of Children and Family Services shall pay
10the DCFS per diem rate for inpatient psychiatric stay at a
11free-standing psychiatric hospital or a hospital with a
12pediatric or adolescent inpatient psychiatric unit effective
13the 11th day when a child is in the hospital beyond medical
14necessity, and the parent or caregiver has denied the child
15access to the home and has refused or failed to make provisions
16for another living arrangement for the child or the child's

1discharge is being delayed due to a pending inquiry or
2investigation by the Department of Children and Family
3Services. If any portion of a hospital stay is reimbursed
4under this Section, the hospital stay shall not be eligible
5for payment under the provisions of Section 14-13 of this
6Code. This Section is inoperative on and after July 1, 2021.
7Notwithstanding the provision of Public Act 101-209 stating
8that this Section is inoperative on and after July 1, 2020,
9this Section is operative from July 1, 2020 through July 1,
102023 June 30, 2021.

13    Section 99. Effective date. This Act takes effect upon
14becoming law or on the date Senate Bill 1510 of the 101st
15General Assembly takes effect, whichever is later.".
