1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Vehicle Code is amended by
5changing Section 6-301 as follows:
 
6    (625 ILCS 5/6-301)  (from Ch. 95 1/2, par. 6-301)
7    Sec. 6-301. Unlawful use of license or permit.
8    (a) It is a violation of this Section for any person:
9        1. To display or cause to be displayed or have in his
10    possession any cancelled, revoked or suspended license or
11    permit;
12        2. To lend his license or permit to any other person or
13    knowingly allow the the use thereof by another;
14        3. To display or represent as his own any license or
15    permit issued to another;
16        4. To fail or refuse to surrender to the Secretary of
17    State or his agent or any peace officer upon his lawful
18    demand, any license or permit, which has been suspended,
19    revoked or cancelled;
20        5. To allow any unlawful use of a license or permit
21    issued to him;
22        6. To submit to an examination or to obtain the
23    services of another person to submit to an examination for

1    the purpose of obtaining a drivers license or permit for
2    some other person.
3    (b) Sentence.
4        1. Any person convicted of a violation of this Section
5    shall be guilty of a Class A misdemeanor and shall be
6    sentenced to a minimum fine of $500 or 50 hours of
7    community service, preferably at an alcohol abuse
8    prevention program, if available.
9        2. Any person convicted of a second or subsequent
10    violation of this Section shall be guilty of a Class 4
11    felony.
12        3. In addition to any other sentence imposed under
13    paragraph 1 or 2 of this subsection (b), a person
14    convicted of a violation of paragraph 6 of subsection (a)
15    shall be imprisoned for not less than 7 days.
16    (c) This Section does not prohibit any lawfully authorized
17investigative, protective, law enforcement or other activity
18of any agency of the United States, State of Illinois or any
19other state or political subdivision thereof.
20    (d) This Section does not apply to licenses and permits
21invalidated under Section 6-301.3 of this Code.
