AMENDMENT TO HOUSE BILL 1022

2    AMENDMENT NO. ______. Amend House Bill 1022 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Notice By Publication Act is amended by
5changing Section 12 as follows:
 
6    (715 ILCS 5/12)
7    Sec. 12. Minority groups.
8    (a) As used in this Section:
9    "Bonds" means any instrument evidencing the obligation to
10pay money authorized or issued by or on behalf of a
11governmental unit under applicable law, including, but not
12limited to, bonds, notes, installment or financing contracts,
13leases, certificates, tax anticipation warrants or notes,
14vouchers, and any other evidences of indebtedness.
15    "Governmental unit" means a township, municipality,
16municipal corporation, unit of local government, school

1district, special district, public corporation, body corporate
2and politic, forest preserve district, fire protection
3district, conservation district, park district, sanitary
4district, and all other local governmental agencies, including
5any entity created by intergovernmental agreement among any of
6the foregoing governmental units. "Governmental unit" not
7include (i) any office, officer, department, division, bureau,
8board, commission, university, or similar agency of the State
9or (ii) any county.
10    "Minority group" means a group that is a readily
11identifiable subset of the U.S. population that is
12distinguished by racial, ethnic, or cultural heritage and by
13non-English language of country of origin.
14    "Minority-owned newspaper" means a newspaper which is at
15least 51% owned by one or more persons of a minority group or
16in the case of a corporation, at least 51% of the stock in
17which is owned by one or more persons of a minority group, and
18the management and daily business operations of which are
19controlled by one or more of the minority group individuals
20who own it.
21    (b) If a notice, other than a notice in connection with the
22issuance of bonds, is required to be published by a
23governmental unit in a newspaper under State law where a
24minority group comprises more than 45% of the residents of the
25governmental unit, the notice shall also be published in a
26minority-owned newspaper in the official language of the

1minority group's country of origin, if such language is not
2English and the newspaper is of general circulation in that
3governmental unit. If a notice, other than a notice in
4connection with the issuance of bonds, is required to be
5published by a county in a newspaper under State law and the
6county includes a municipality in which a minority group
7comprises more than 45% of the residents of the municipality,
8for each such municipality, the county shall also publish the
9notice in a minority-owned newspaper in the official language
10of the minority group's country of origin, if such language is
11not English and the newspaper is of general circulation in
12that municipality.
13    (c) Any error in the determination by a county or
14governmental unit that a minority group does not comprise more
15than 45% of the residents of a governmental unit or any error
16in any notice published in an official language of a minority
17group's country of origin pursuant to this Section that is not
18deliberate shall not invalidate or affect the validity of any
19publication.
20If a notice is required to be published in a newspaper under
21this Act where the city, town, or county consists of more than
2245% of a single minority group, the notice shall also be
23published in a local newspaper of that minority group, if
24available, and in the official language of the minority
25group's country of origin.
